MINUTES <br />CITY COUNCIL <br />NOVEMBER 30, 2022 <br />The Community Development Director explained that on July 27, 2022, the City Council reviewed the <br />application for a subdivision and variances, as well and listened to input from the public. She stated <br />that the Council opted to table the discussion and referred the application back to the Planning <br />Commission to review the changes that had been made to the Preliminary Plat given new information <br />from the Watershed District, input from the residents, and recommendations from the Council meeting. <br />The Planning Commission reviewed the updated Preliminary Plat on August 11, 2022, and <br />recommended approval to the City Council. The Community Development Director reported that on <br />August 24, 2022, the City Council reviewed the updated application and again tabled the discussion to <br />have the applicant provide more detailed information from the watershed district. She explained that <br />the current Preliminary Plat has been modified to address concerns from residents and the Council, <br />such as the total lots decreased from 8 lots to 7 lots; an outlot has been created on the north end to <br />accommodate stormwater management; all lots now meet the minimum R-1 district requirement for <br />10,000 square feet of lot area which eliminates the need for the request for a lot size variance.; the <br />Watershed District has issued a letter of compliance with conditions; the street grade has been reduced <br />from 8.0% to 7.5% with the inclusion of a longer flat area (2.5%) near the curve and intersection with <br />Edgerton Street; and the lots on the west side of the development are now a tuck -under garage home <br />style to reduce the retaining wall size. <br />Torkelson asked about the stormwater retention pond on the north end of the property, and asked if <br />trees would be removed. The City Engineer stated that the entire area would need to be regraded in <br />order to put in the retention pond. Torkelson stated that he is disappointed since it is a nature walk <br />area, and there are some very large trees, and he would like to understand which trees exactly will be <br />removed. The City Engineer has asked the developer to do a tree inventory along the west side and <br />can also have -them do that on the north end. He explained that the city will take over -the outlot areas <br />and maintain them, which is typical for a development. <br />Keis opened the public hearing. <br />Justin Parta, 2655 Edgerton Street, stated his property is adjacent to this development. He asked for <br />clarification on what the street length will be. He explained that he has a Silver Maple tree near the <br />property line, and stated that the Department of Natural Resources will be coming out to recognize it as <br />a historical tree. He stated that he will hold the City and the developer responsible if the tree is <br />impacted, plus he has two more Maple trees that he is concerned about. He understands that there is a <br />right to develop your property, but he does not feel that this proposal is ready yet, and he and the <br />neighbors need more time to consider this. He stated that the development could be done without the <br />removal of so many trees, and there is a lot of wildlife that live in there. He asked the City Council to <br />give more attention to additional details. <br />Jessica Turcotte, 2674 Schletty Drive, noted that the layout has changed since the last time the Council <br />reviewed it, and there now appears to be an effort to not kill the trees in her backyard. She stated that <br />the changes have not been explained to them. She does not know how the layout of the homes will be, <br />so is unsure of the height near her property. She stated she has concerns about what happens to water <br />runoff when the new homes add patios and decks. She noted she has had to regrade her yard twice and <br />install a sump pump for her yard due to flooding problems, and is concerned about anything that could <br />potentially add water.
