MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 12, 2009 <br />OUTDOOR noted that the property was granted a PUD Permit in 2007 for the <br />STORAGE - display of one gazebo on the south side of their property from March 1st <br />2905 to October 3152 of each year. Given code enforcement actions in that the <br />COUNTRY gazebo was not removed as required, the property owner applied for an <br />DRIVE - amended PUD Permit in 2008 allowing year round display of the gazebo <br />TEMO as well as year round storage of up to three additional display trailers and a <br />SUNROOMS commercial dumpster. The Council approved the following: <br />o PUD Permit allowing display of gazebo from March 151 to <br />October 3151; <br />o Temporary PUD Permit allowing outdoor storage of up to <br />three display trailers from April 15C through October 3151 for <br />2008 and 2009 with a review in October, 2009 to consider <br />the possibility of extending this permit. <br />The City Planner noted that his February 6, 2009 report lays out some <br />Options relative to enforcement of the existing PUD Permits. The <br />Planner indicated that the City Administrator is recommending that the <br />Planning Commission consider the revocation issue, but felt it may be <br />appropriate to table action on it until the October, 2009 review. This will <br />allow the applicant some time to meet the conditions of the PUD Permits. <br />The Planner noted that if action is tabled, the Council will consider the <br />PUD Permits at their November 111h meeting. <br />Bob Maietta, Temo Sunrooms, stated that when he purchased this property <br />he was naive to believe that he could store trailers in his parking lot. <br />Maietta pointed out the impact that both the economy and the City's <br />assessment for the Condit Street project has had on his property. This has <br />further contributed to the stress of running a small business. Maietta <br />reported that he did not take the two display hailers down for two reasons, <br />the cost and cold. <br />Maietta reported that he has been working with Home Depot to place his <br />display trailers, but it took them 3 %z months to make a decision. Maietta <br />reported that his option was to have the trailers stored off-site at <br />significant cost. He noted that his revenues ai•e down. Maietta admitted <br />that he was negligent in not moving the hailers out and stated that he has <br />no excuse. However, when he looks around the area, Maietta stated that <br />he sees much worse things than the storage of his trailers. <br />Knudsen noted that the City extended the storage through October for <br />Maietta, and that Maietta had indicated he could live with that time line. <br />Maietta felt that his investment in his property and his track record with <br />the City should count for something, and noted that some circumstances <br />are beyond his conriol. Maietta stated that he must prioritize his <br />resources. He hoped that by fall the economy would be better and he <br />would be in a position to achieve full compliance.
