MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 12, 2009 <br />The Commission discussed the sheds, with their consensus being that the <br />non-conforming shed should be eliminated as soon as possible. The tennis <br />court and remaining shed could exist until the time of Final Plat. The <br />Commission also asked for a tree preservation plan for this property. <br />The City Planner indicated that the building envelope plan would help to <br />judge tree preservation. He noted the developers' indication that each lot <br />will be custom graded with removal of only those trees necessary for <br />house and driveway construction. <br />Fischer agreed that the building envelope plan will satisfy a lot of the <br />concerns expressed this evening. Barraclough noted that these will be $1 <br />million homes and the developers will want to preserve the h•ees as well as <br />site the homes to establish views of the lake. Johnson agreed and <br />indicated that the line of the Huot house would likely be followed for Lots <br />3, 4, and 5 with the homes sited as far east as possible. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Barraclough recommended approval of the Preliminary Plat for the Huot <br />Addition consisting of five single-family lots at 565 Little Canada Road <br />subject to compliance with the recommendations of the City Planner as <br />ouflined in his February 5, 2009 report, the City Engineer as outlined in <br />his February 4, 2009 report, the recommendation of the Parks & <br />Recreation Commission, submission of a building envelope plan, and <br />immediate removal of the one non-conforming storage shed. <br />Motion seconded by Fischer. <br />Motion carried 6 - 0. <br />APPEAL OF Bill and Renee Galvin, 882 Westwind Drive, appeared before the <br />ZONING Commission appealing the City's Zoning Code definition which limits <br />CODE single family size to no more than three unrelated individuals to <br />DEFINITION- accommodate the occupancy of 882 Westwind Drive by four unrelated <br />882 WESTWIND individuals. Bill Galvin reported that they would like to rent their home <br />DRIVE - to their disabled daughter as well as three other women of similar <br />GALVIN disability. Given that the staffing ratio for such a situation is one to four, <br /> it works economically to rent to four disabled individuals, rather than just <br /> three. Galvin reported that the young women would be supervised by a <br /> staff person at all times that they are at home. Only when the women are <br /> working would the house be empty. <br />Knudsen asked why the Galvins are not applying for group home status. <br />-9- <br />
