MINUTES CITY COUNCIL FEBRUARY 25, 2009 The foregoing resolution was duly seconded by McGraw. Ayes (~4). Nays (0). Resolution declared adopted. REVOCATION Montour opened the Public Hearing to consider the revocation of PUD OF PUD Permits for Temo Sunrooms located at 2905 Country Drive. PERMITS - 2905 The City Administrator reviewed the reports of the Code Enforcement COUNTRY Officer relative to the initial PUD Permit and the fact that the property was DRIVE - out of compliance with the terms of that Permit. Consequently, the TEMO property owner applied for an Amendment to the PUD Permit. The SUNROOMS Council granted some modifications to the original permit, but the property owner is now out of compliance with that permit as well. The Administrator noted that the main issues are outdoor storage of a gazebo, storage trailers, and trash bins. The Administrator also reported that there was discussion at the Planning Commission meeting about debris that was lying in the parking lot. That debris was picked up, but there are additional issues in this regard. Keis reported that he visited the property this afternoon and there were tires and one trailer in the parking lot. The City Administrator presented some pictures of the property that were Taken today which shows that one of the approved trailers has returned to the property as well as another unapproved trailer with debris on it. There are also tires along side the outbuilding. He noted that one of the conditions of the PUD Permit is that the trailers are not to be stored on the property from November 1 ~` through March 31 s` of each year. The Adminish•ator indicated that options for the Council include revoking the PUD Permits at this time, giving some additional time for compliance, or tabling action on the revocation until the first Council meeting in November. If the Council is inclined to provide additional time, the Administrator recommended the following conditions: Debris to be removed immediately; Tires to be removed immediately; Dumpster to be stored inside the building; Trailers and gazebo to be removed from the property by 11-1-09. It was noted that the property owner is not present this evening. Keis expressed concern about the absence of the property owner. He also asked how the courts would view the City in continuing to grant the property owner additional time for compliance. The City Attorney stated that there would be no penalty to the City in granting additional time. 13
