MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2009 <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (~4). <br />Nays (0). Resolution declared adopted. <br />REVOCATION Montour opened the Public Hearing to consider the revocation of PUD <br />OF PUD Permits for Temo Sunrooms located at 2905 Country Drive. <br />PERMITS - <br />2905 The City Administrator reviewed the reports of the Code Enforcement <br />COUNTRY Officer relative to the initial PUD Permit and the fact that the property was <br />DRIVE - out of compliance with the terms of that Permit. Consequently, the <br />TEMO property owner applied for an Amendment to the PUD Permit. The <br />SUNROOMS Council granted some modifications to the original permit, but the <br /> property owner is now out of compliance with that permit as well. The <br /> Administrator noted that the main issues are outdoor storage of a gazebo, <br /> storage trailers, and trash bins. The Administrator also reported that there <br /> was discussion at the Planning Commission meeting about debris that was <br /> lying in the parking lot. That debris was picked up, but there are <br /> additional issues in this regard. <br />Keis reported that he visited the property this afternoon and there were <br />tires and one trailer in the parking lot. <br />The City Administrator presented some pictures of the property that were <br />Taken today which shows that one of the approved trailers has returned to <br />the property as well as another unapproved trailer with debris on it. There <br />are also tires along side the outbuilding. He noted that one of the <br />conditions of the PUD Permit is that the trailers are not to be stored on the <br />property from November 1 ~` through March 31 s` of each year. The <br />Adminish•ator indicated that options for the Council include revoking the <br />PUD Permits at this time, giving some additional time for compliance, or <br />tabling action on the revocation until the first Council meeting in <br />November. If the Council is inclined to provide additional time, the <br />Administrator recommended the following conditions: <br />Debris to be removed immediately; <br />Tires to be removed immediately; <br />Dumpster to be stored inside the building; <br />Trailers and gazebo to be removed from the property by 11-1-09. <br />It was noted that the property owner is not present this evening. Keis <br />expressed concern about the absence of the property owner. He also asked <br />how the courts would view the City in continuing to grant the property <br />owner additional time for compliance. The City Attorney stated that there <br />would be no penalty to the City in granting additional time. <br />13 <br />
