MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2009 <br />OUTDOOR The City Planner reviewed a proposed ordinance which provides for the <br />STORAGE licensing of the outdoor storage use. The Planner noted that this licensing <br />LICENSING requirement relates to Zoning Code amendments made relative to outdoor <br />ORDINANCE storage and ties the licensing process as a condition of the use. He noted <br />that the proposed ordinance includes revocation language relative to this <br />particular license. The Planner pointed out that the City Attorney will be <br />proposing some general enforcement language to be added to the City <br />Code at a later date. <br />Keis asked the process for adoption of this ordinance. The City Planner <br />noted that the ordinance would become part of the City Code, therefore, <br />does not require a public hearing to adopt. Once adopted, the City would <br />amendment is Fee Ordinance to establish an outdoor storage license fee. <br />Roger Stanke, Ryan Industrial Park, expressed surprise at the creation of <br />an outdoor storage license. He noted the process undertaken to amend <br />outdoor storage requirements under the Zoning Code, and felt that those <br />amendments had resolved the issues of concern. Stanke indicated that the <br />Ryan Industrial Pvk property owners were not aware that an outdoor <br />storage license would be created as well. He noted that business license <br />fees for many of the businesses in the Park had been increased over the <br />past three years from $50 to $300. Stanke expressed concern about yet <br />another license fee. <br />Montour stated that it was his recollection that in addition to the Zoning <br />Code amendment relative to outdoor storage there was significant <br />discussion about the licensing of outdoor storage. Keis agreed, noting that <br />the license provides the City with another control mechanism. <br />Stanke noted that the businesses in the Park have amended their CUP's <br />based on the Code changes. He indicated that the businesses are under the <br />assumption that this was all that would be needed and were not aware that <br />an outdoor storage license would be created. Stanke stated that this was <br />not explained to the property owners. He felt that the creation of this <br />license would open the outdoor storage issue up again. Stanke expressed <br />concern about the City taking more and more conh•ol of properties in the <br />Park. <br />Keis noted that he is very surprised that Stanke was surprised by the <br />outdoor storage licensing. Keis noted that the issue was discussed in <br />depth. <br />The City Administrator pointed out that only those Ryan Industrial Park <br />property owners with issues of CUP compliance had to redo their CUP's. <br />He further noted that the outdoor storage license is not a revenue <br />15 <br />
