MINUTES <br />CITY COUNCIL <br />MARCH 25, 2009 <br />to be added to screen the trash dumpster from view. Blesener asked if <br />Maietta would be adding on this trash enclosure to the existing one or to <br />the building itself. Maietta stated that he would likely add it to the <br />building as his intention still is to tear down the existing trash enclosure <br />and construct the 800 square foot garage/dumpster enclosure sriucture that <br />was approved on May 23, 2007. Maietta felt there was adequate room on <br />the west wall of the building to add a ri•ash enclosure. <br />Blesener suggested that consideration of the revocation be tabled another <br />month to give Mr. Maietta an opportunity to apply for a PUD amendment <br />relative to the new trash enclosure. It was noted that the April deadline <br />has passed; therefore, the matter should be tabled until the second meeting <br />in May. The City Administrator indicated that the revocation hearing <br />could be continued until that same meeting and both items considered at <br />the same time. <br />Maietta expressed concern that the City is holding his property to higher <br />standards than the neighboring residential properties on Condit Street. <br />Maietta also noted that he is operating a business and does not have time <br />to police his parking lot on a daily basis. The City Administrator reported <br />that there are code enforcement actions underway with these residential <br />properties. Montour noted that the City is enforcing the standards that Mr. <br />Maietta agreed to as part of the PUD approval process. Montour also <br />noted that it is standard practice for businesses to police their properties to <br />ensure that they are neat and orderly. Maietta indicated that he only <br />agreed to the PUD conditions because those conditions were required by <br />the City. He again asked that his neighbors be held to the same standard. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION N0.2009-3-68 -TABLING ACTION ON THE <br />REVOCATION OF PUD PERMITS FOR THE TEMO SUNROOM <br />PROPERTY, 2905COUNTRYDRIVE, UNTIL THEMAY27, 2009 <br />COUNCIL MEETING TO GIVE THE MR. MAIETTA AN <br />OPPORTUNITY TO REQUEST A PUD PERMIT AMENDMENT TO <br />CONSTRUCT ANADDITIONAL TRASH ENCLOSURE ON THE <br />PROPERTY <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0).
