<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Fischer and Members of City Council <br /> <br />FROM: Heidi Heller, City Clerk/HR Manager <br /> <br />DATE: July 26, 2023 <br /> <br />RE: Ordinance 875, Amending City Code Chapter 802, Tobacco <br /> <br /> <br />ACTION TO BE CONSIDERED: <br />Consider adoption of Ordinance 875, Amending City Code Chapter 802, Tobacco, to add allowed <br />hours of operation for tobacco stores. <br /> <br />BACKGROUND: <br /> <br />At the July 12, 2023 City Council meeting, the Council heard concerns from business owners <br />about the late hours that The Hookah Hideout stays open, and Council requested that one of the <br />conditions of their tobacco store license be restricted hours of operation. The City Code currently <br />has no restrictions on hours of operation for either type of tobacco license (tobacco store or <br />general sales & display). Staff recommended adding this as a condition of their license if it were <br />approved, but also adding this restriction to the Tobacco Chapter of the City Code so it would be <br />applicable to both tobacco stores in the city. Staff has prepared an Ordinance that amends City <br />Code Chapter 802, Tobacco, to add allowed hours of operation for tobacco stores. Staff has <br />suggested hours of operation from 8:00 a.m. to 11:00 p.m., but Council can make the final <br />determination on the times. These hours of operation are recommended only for Tobacco Store <br />licenses, not the General Sales & Display Tobacco Licenses that gas stations and liquor stores <br />have. <br /> <br />If Ordinance 875 is adopted on July 26, the ordinance would be published on July 30, 2023 and <br />the new hours of operation requirement would go into effect that day. <br /> <br />STAFF RECOMMENDATION: <br />Staff recommends Council discuss and consider adopting Ordinance 875, Amending Chapter <br />802, Tobacco, to add allowed hours of operation for tobacco stores.
