AN ORDINANCE CREATING CHAPTER 800 OF THE LITTLE CANADA CITY <br />CODE, ESTABLISHING A GENERAL PRACTICE AND PROCEDURE FOR THE <br />LICENSING OF BUSINESSES WITHIN THE CITY. <br />1'HE CITY COUNCIL OF THE CITY OF LITTLE CANADA, MINNESOTA <br />ORDAINS: The Little Canada City Code is amended to insert the following new Chapter <br />800, entitled "Licensing Procedures": <br />Section 1 <br />800.010. GENERAL LICENSING POLICIES AND PROCEDURES. "I'he City Clerk <br />shall be responsible for processing and issuing city licenses. <br />A. Revocation and suspension of licenses. The City Council shall have the power to <br />suspend or revoke the license of any person licensed by the City found to be in violation <br />of the terms of their license or other applicable laws. <br />1. Before taking such action, the person holding such license must be given 20 <br />days' notice and granted the opportunity to be heard before the Council or an <br />advisory board, depending on the license, before such action is taken. <br />2. The notice shall generally state: the proposed license action; the time, place <br />and circumstances of the allegations against the licensee; the governing body that <br />will conduct the hearing; and the time and place of the hoaring. If the hearing is <br />not held before the City Council, the notice shall advise the licensee of the time <br />and place of the Cowrcil's meeting to consider the hearing panel's <br />recommendation. If documents will be used to substantiate the license action, the <br />notice shall advise that the documents are available at City Hall for inspection and <br />copying. <br />3. The notice will clearly state, in emphasized text, that failure to either appear at <br />the hearing or submit a written waiver of the hearing will result in the suspension <br />or revocation of the license. <br />4. The notice shall be sent by first-class mail to the licensee's legal address on <br />file with the City Clerk. If and when such notice is sent to the legal address on <br />file and the licensee fails or reiiases to appear at the hearing, the license will be <br />automatically suspended or revoked five days after the date of the hearing. <br />5. The Council or hearing panel shall apply any criteria supplied in the City <br />ordinance creafing the license. If the licensee has been convicted in a criminal <br />court for the offense which gives rise to the suspension or revocation action, the <br />City may take the conviction as conclusive proof of the offense, and determine the <br />appropriate license penalty. <br />17 <br />
