B. When a license is suspended under 800.010(A), the period of suspension shall not be <br />less than 30 days nor more than one year, such period being determined by the city <br />council, <br />C. Automatic revocation. When any person holding a license issued by the City has <br />been convicted for the second time by a court of competent jurisdiction for violation of <br />any of the sections of a City ordinance relating to the subject matter of the license, the <br />city council shall revoke the license of the person so convicted. Such person may not <br />make application for a new license for a period of one year. <br />D. Appeals of Administrative Decisions. Any licensee agln•ieved by any order, <br />requirement or other decision of the City Administrator or other City official which <br />directly affects the ability of the licensee to undertake the licensed activity may appeal <br />the matter to the City Council. The licensee must submit a written request for a hearing <br />to the City Administrator. The City Administrator must schedule a date for hearing <br />before the Council and notify the aggrieved person of the date. The date chosen for <br />hearing must be within thirty {30) days of the date an appeal request is received, unless <br />otherwise requested by the grievant. The Council shall allow the grievant to speak on the <br />appeal and present other witnesses and documentation as may be reasonable for the <br />ln•ievant to state his or her case. The Council may also allow the City staff involved to <br />present information supporting their action. At the close of the hearing, the Cowtcil may <br />make a decision to overturn the administrative action, uphold the administrative action, or <br />to continue the matter to the next meeting Co gather further information. <br />800.020 PROSECUTION. In addition to any fines, costs, or assessments provided for by <br />City Ordinances, the City may prosecute a violation of any provision of this chapter as a <br />misdemeanor, and a person, if convicted, may be punished by the maximum fine and <br />form of imprisonment provided by Minnesota Statutes ~ 609.02, subd. 3, as that statute <br />may be amended from time to time. <br />800.030 CJnless otherwise specifically or expressly provided, the amount of fees due the <br />city for the licensed activities described in this chapter shall be set from time to time by <br />the City Council, and a schedule of such £ees shall be on file and available for inspection <br />by the public. <br />800.040 POSTING OE BUSINESS LICENSES. Business licenses issued by the City of <br />Little Canada, shall be posted in a conspicuous location in the licensed business location <br />and viewable to the public who visits this licensed business. <br />800.050 SEVERABILITY. Should any section, subdivision, clause or other provision o£ <br />this Ordinance be held to be invalid by any court of competent jurisdiction, such decision <br />shall not affect the validity of the Ordinance as a whole, or of any part thereof, other than <br />the part held to be invalid. <br />18 <br />
