MINUTES <br />CITY COUNCIL <br />OCTOBER 11, 2023 <br />STAFF REPORTS <br />ORDINANCE 882, AMENDING CITY CODE CHAPTER 802, TOBACCO FOR GENERAL <br />SALES AND DISPLAY LICENSES <br />The City Clerk explained that this was also discussed at a recent workshop and recapped the two types <br />of licensing that the City has related to tobacco. She stated that a gas station owner has reached out <br />with a desire to sell their business, but under the current ordinance the tobacco license would not <br />transfer, and the gas station would then not have the ability to sell tobacco products. She noted that as <br />more people pay at the pump for gas, the gas station needs products to bring people in to increase <br />sales. She stated that this proposed change would allow an existing business holding a general sales <br />and display license as of May 25, 2022 to transfer the license with the sale of the business to another <br />party. <br />Mayor Fischer recognized that there were intentional changes made in 2022 to scale away from <br />tobacco. He was glad to see that this is in front of the Council as this was one change that was <br />punitive. He welcomed input from the public. <br />T. Miller commented that she does stick by the original decisions that were made in the past and did <br />not believe those were meant to be punitive, and therefore would stick by that. Mayor Fischer agreed <br />that the intent was not meant to be punitive, but perhaps it ended up being punitive. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTIONNO. l l-118 — ADOPTING ORDINANCE <br />CODE CHAPTER 802.025, TOBACCO, TO ALLOWA NEW OWNER OFANEXISTIN <br />BUSINESS TO BE ISSUED A GENERAL SALES AND DISPLA Y TOBACCO LICEN <br />The foregoing resolution was duly seconded by D. Miller. <br />Ayes (4). Nays (1) (T. Miller opposed). Resolution declared adopted. <br />ACCEPT FEASIBILITY REPORTS FOR 2024 STREET IMPROVEMENT PROJECTS ON <br />COUNTRY DRIVE AND JACKSON STREET AND CALL FOR IMPROVEMENT <br />HEARINGS <br />The City Engineer stated that the intent is to summarize the feasibility report for the proposed 2024 <br />street improvement projects. He provided details on the City's infrastructure improvement planning. <br />He provided details on the two project areas, Country Drive and Jackson Street, as well as the <br />proposed improvements for those areas. He reviewed details on the estimated costs and proposed <br />funding. He also provided details on special assessments and assessable properties. He reviewed the <br />anticipated project timeline noting the neighborhood open house that was held on September 26tn <br />T.
