MINUTES <br />CITY COUNCIL <br />NOVEMBER 29, 2023 <br />Mayor Fischer commented that City staff has been more than kind when describing the condition of <br />the property. He agreed that it is better, but it is still not okay. He asked and received confirmation <br />that the bank does own the property, but the property owner has a certain number of days before the <br />property must be vacated. He commented that he visited the property today and there are items of <br />value. He asked how the evaluation would be done as to what goes in the trash and what goes into <br />storage. <br />The Community Development Director commented that they could work with the property owner to <br />determine what is trash and what the property owner would like to move to storage. The City <br />Administrator commented that it is a judgement call, but noted that the property owner is somewhat <br />cooperative and can help to identify some of those things. He noted that this action would provide the <br />City with the authority to step in, if needed. He stated that if they do not move forward now, the City <br />would need to start over with this process in the spring with the new property owner. Mayor Fischer <br />commented that while this seems like a fast timeline, the City has been working with this property <br />owner for over 18 months. <br />D. Miller asked if the property condition was worse when the first complaint came in, or whether it has <br />deteriorated. The Community Development Manager commented that the items of complaint have <br />been changed over time and provided more details. D. Miller asked why it took 18 months to get to <br />this point. Mayor Fischer commented that changes were just made to the ordinance. <br />The Community Development Director provided details on the previous process that was followed for <br />code enforcement that delayed compliance. The City Clerk provided additional input noting that the <br />property owner intended to live at the property, but because of damage sustained, did not and then it <br />seemed to have become a place for items to be dumped/stored. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2 023-11-14 7 — A UTHORIZING CODE ENFOR CEMENT A CTION <br />UNDER CHAPTER 601 AND CHAPTER 3301 OF THE CITY CODE FOR THE <br />PROPERTYLOCATED AT 2975 ARCADE STREET TO CONDUCT THE FOLLOWING <br />ABATEMENT. <br />• HAVE NUISANCE TO BE ABATED AT THE EXPENSE OF THE CITY AND <br />RECOVER SUCH COSTS AGAINST THE PERSON OR PERSONS SERVED. <br />• TO COVER ADMINISTRATIVE COSTS NECESSARILYINCURRED IN THE <br />ABATEMENT AND ASSESSMENT PROCEDURE, ANADMINISTRATIVE FEE <br />IN THE AMOUNT OF NOT MORE THAN 25 PERCENT OF THE COST TO <br />ABATE THE NUISANCE SHALL BE IMPOSED, EXCEPT THA T IN NO EVENT <br />SHALL THE ADMINISTRATIVE FEE BE LESS THAN $250. <br />The foregoing resolution was duly seconded by Mayor Fischer. <br />Ayes (5).
