MINUTES <br />CITY COUNCIL <br />JANUARY 10, 2024 <br />RESOLUTION NO. 2024-1-5 —APPROVING THE 2024 CITY COUNCIL COMMITTEE <br />APPOINTMENTS <br />The foregoing resolution was duly seconded by T. Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />CITY COUNCIL CODE OF CONDUCT POLICY <br />The City Clerk explained tonight the Council is asked to consider the draft City Council code of <br />conduct policy. She commented that there is no timeline and therefore if changes are desired this <br />could come back at a future meeting. <br />D. Miller asked if there are other city or state policies that address donations. The City Clerk <br />confirmed that there is overlap in some areas related to state law. Mayor Fischer stated that he initially <br />envisioned one page for this type of policy, but this dives much deeper. He stated that he is fine <br />approving this as is, but perhaps in the future this could be paired down. <br />D. Miller asked if each member of the Council would need to sign the document as individuals. He <br />commented that if individuals sign this, that would have different implications than a typical policy. <br />Mayor Fischer agreed that this in more in depth than he intended and would not see that each member <br />would need to sign it. The City Clerk commented that this is more of a policy than a contract. She <br />noted that in her review of other cities, only Rochester required signatures but stated that is a charter <br />city and that process is much more formal with repercussions if members do not follow that. She <br />reiterated that most of the information within this draft policy is already in state law and expected to be <br />followed. She noted that some matters are subjective, and the Council would retain the ability to <br />censure members if it felt necessary. <br />Mayor Fischer commented that there is value in this draft policy and appreciates the research that has <br />been put into this process. Gutierrez stated that this information would be helpful for new members <br />joining and to help set the proper expectations for behavior. Kwapick stated that if adopted, it would <br />be good to have a regular review to ensure that the policy continues to be adequate. The City Clerk <br />confirmed that this could be done each January. <br />Gutierrez introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2024-1-6 — ADOPTING THE CITY CO UNCIL CODE OF COND UCT <br />POLICY AS PRESENTED <br />The foregoing resolution was duly seconded by D. Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />COUNCIL REPORTS AND MEETING UPDATES <br />D. Miller commented that he will be forwarding an email from the Cable Commission related to a law <br />that would impact the entity, providing abilities to telecommunication companies. <br />3 <br />
