MINUTES <br />CITY COUNCIL <br />JANUARY 24, 2024 <br /> <br /> <br /> <br /> <br />2 <br />There were no comments from the public. Upon motion by D. Miller, seconded by T. Miller, the <br />public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br /> <br />Mayor Fischer noted that this is the 3rd Addition, so the Council is familiar with this development. He <br />commented that it is nice to see it all come together. <br /> <br />Kwapick introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 2023-1-8 – APPROVING THE FINAL PLAT 3RD ADDITION FOR <br />PIONEER COMMONS AND THE DEVELOPMENT AGREEMENT WITH THE <br />FOLLOWING CONDITION: <br />1. THE 3RD ADDITION MAY NOT BEGIN UNTIL THE BP OIL CROSSING IS <br />RESOLVED BY WRITTEN AGREEMENT OR PERMIT WITH BP OIL. <br /> <br /> The foregoing resolution was duly seconded by T. Miller. <br /> Ayes (5). Nays (0). Resolution declared adopted. <br /> <br />VARIANCE AMENDMENT FOR SIGNAGE AT CARIBOU COFFEE AT 3354 RICE STREET <br />The Community Development Director provided background information on the request from Caribou <br />Coffee located at 3354 Rice Street. She stated that a variance was issued in 2019 to allow additional <br />signage because of the on-going construction of the roundabouts and Interstate 694. She stated that the <br />second sign was intended to sunset in 2021, noting delays in bringing this forward because of COVID <br />and relaxing of City regulations for businesses. She stated that this is coming forward now to resolve <br />the issue. She provided more input from the applicant on the impact of COVID and the triple <br />roundabouts to the business and stated that at the January 11 meeting, the Planning Commission <br />recommended to permanently allow the use of the second monument sign with the condition that the <br />property foregoes any additional signage square footage requests. She reviewed the variance findings <br />and asked that the Council hold the public hearing and consider the request. <br /> <br />Mayor Fischer opened the public hearing for comments from the general public. <br /> <br />There were no comments from the public. Upon motion by T. Miller, seconded by D. Miller, the <br />public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br /> <br />D. Miller asked and received confirmation that the applicant would typically be allowed 435 square <br />feet of signage between monument and building signage. He noted that with the current signage, there <br />would only be 35 square feet left available and therefore that condition would seem unnecessary. He <br />agreed that the sign is helpful in wayfinding. <br /> <br />Mayor Fischer asked if the signage square footage would include directional signage. The Community <br />Development Director confirmed that the square footage would include all types of signage. <br /> <br />D. Miller asked if temporary signage is handled differently. The Community Development Director <br />confirmed that there is a temporary sign permit that would allow for temporary signage up to four <br />times per year in addition to what is allowed under the zoning ordinance. <br />
