MINUTES
CITY COUNCIL
JUNE 22, 2009
IN HIS MAY 29, 2009 REPORT, AND THE WATERSHED PERMIT
ISSUED ON JUNE 4, 2009
The foregoing resolution was seconded by Boss.
Ayes (5).
Nays (0). Resolution declared adopted.
PRELIMINARY Mayor Blesener opened the Public Hearing to consider a Preliminary and
AND FINAL Final Plat, Planned Unit Development Permit to develop a family, quiclo-
PLAT, PUD service restaurant consisting of approximately 88 seats as well as a drive-
PERMIT, through window, Architectural Review, Canprehensive Sign Plan, as well
ARCHITECTURA Las the Vacation of public right-of--way over Outlot A, Market Place, for
RF,VIEW, Culvers Restaurant. It was noted that the City Planner, City Engineer, and
COMP. Planning Commission have recommended approval subject to conditions.
SIGN PLAN, AND
VACATION OF T'he City Planner reviewed the proposal of Sweet Cream Enterprises for
RIGHT-OF-WAY -the development of a Culvers Restaurant on the southeast corner of Rice
CULVERS Street and Market Place Drive. The restaurant will consist of 4,000 square
RESTAURANT feet on a one acre site. The Planner noted that the Preliminary and Pinal
Plat consists of two lots with Culvers to be developed on Lot 1 and a
future 5,000 square foot commercial building on Lot 2.
The City Planner noted that Outlot A, Market Place, is a part of the plat.
There is public right-of-way over Outlot A that the developer is requesting
be vacated. The City Engineer has reviewed the vacation request and
there are no issues as the public right-of--way serves no public purpose.
The City Planner indicated that the biggest issue with the Culvers proposal
relates to parking. The site plan shows 52 parking spaces and the Code
requirement is for 54 spaces. There are several options available to
resolve this issue. Those options include a reconfiguration of the property
line, a joint parking agreement, a reduction in building size or activity area
within the building thus reducing the parking demand, or a reconfiguration
of the site to add 2 additional spaces. The Planner reported that it is his
understand that the applicant has a resolution to the parking issue which he
will propose to the Council.
The Pla~sner noted that staff is recommending that the Culvers site lighting
comply with the ordinance requiring that lights be shielded and directed
inward to the site. The Planner also reported that signage is acceptable,
noting the request of the applicant for a second pylon sign on Lot 1
identifying the future business that will locate on Lot 2.
The City Administrator indicated that any approvals this evening should
be contingent on compliance with Ramsey County's recommendations
relative to the final plat.
4
