MINUTES <br />CITY COUNCIL <br />JUNE 22, 2009 <br />IN HIS MAY 29, 2009 REPORT, AND THE WATERSHED PERMIT <br />ISSUED ON JUNE 4, 2009 <br />The foregoing resolution was seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PRELIMINARY Mayor Blesener opened the Public Hearing to consider a Preliminary and <br />AND FINAL Final Plat, Planned Unit Development Permit to develop a family, quiclo- <br />PLAT, PUD service restaurant consisting of approximately 88 seats as well as a drive- <br />PERMIT, through window, Architectural Review, Canprehensive Sign Plan, as well <br />ARCHITECTURA Las the Vacation of public right-of--way over Outlot A, Market Place, for <br />RF,VIEW, Culvers Restaurant. It was noted that the City Planner, City Engineer, and <br />COMP. Planning Commission have recommended approval subject to conditions. <br />SIGN PLAN, AND <br />VACATION OF T'he City Planner reviewed the proposal of Sweet Cream Enterprises for <br />RIGHT-OF-WAY -the development of a Culvers Restaurant on the southeast corner of Rice <br />CULVERS Street and Market Place Drive. The restaurant will consist of 4,000 square <br />RESTAURANT feet on a one acre site. The Planner noted that the Preliminary and Pinal <br />Plat consists of two lots with Culvers to be developed on Lot 1 and a <br />future 5,000 square foot commercial building on Lot 2. <br />The City Planner noted that Outlot A, Market Place, is a part of the plat. <br />There is public right-of-way over Outlot A that the developer is requesting <br />be vacated. The City Engineer has reviewed the vacation request and <br />there are no issues as the public right-of--way serves no public purpose. <br />The City Planner indicated that the biggest issue with the Culvers proposal <br />relates to parking. The site plan shows 52 parking spaces and the Code <br />requirement is for 54 spaces. There are several options available to <br />resolve this issue. Those options include a reconfiguration of the property <br />line, a joint parking agreement, a reduction in building size or activity area <br />within the building thus reducing the parking demand, or a reconfiguration <br />of the site to add 2 additional spaces. The Planner reported that it is his <br />understand that the applicant has a resolution to the parking issue which he <br />will propose to the Council. <br />The Pla~sner noted that staff is recommending that the Culvers site lighting <br />comply with the ordinance requiring that lights be shielded and directed <br />inward to the site. The Planner also reported that signage is acceptable, <br />noting the request of the applicant for a second pylon sign on Lot 1 <br />identifying the future business that will locate on Lot 2. <br />The City Administrator indicated that any approvals this evening should <br />be contingent on compliance with Ramsey County's recommendations <br />relative to the final plat. <br />4 <br />
