Little Canada Planning Commission <br />5 September 1978 Page Two <br />M <br />At the Planning Commission meeting in which the Ryan Industrial Park preliminary <br />plat was discussed, it was suggested that, due to the number of easements existing on <br />the property (Amoco, NSP and St. Paul Waterworks), Mr. Ryan should clear all <br />construction proposals with the concerned parties. It has since been discovered that <br />the St. Paul Waterworks and presumably Amoco and NSP require permits for any <br />development which occurs on their properties. The City has no power to waive these <br />requirements and the permits should be obtained before the City issues building <br />permits. <br />An issue which has arisen in Little Canada with regard to development is that of <br />enforcement. This is especially evident in the case of Ryan Industrial Park. The <br />location of the building on Lot 3, Block 2 supports this argument. The building <br />in question was allowed to be built with a 30 foot front yard setback rather than <br />the required 40 feet. In addition, the driveway and entrance doors are situated so <br />as to encourage and even necessitate vehicles maneuvering on or from the public <br />street. In the future, it is suggested that enforcement of the code requirements are <br />more closely adhered to, in order that everyone who must abide by the requirements <br />be treated eq ua I I y . <br />The following are issues which must be resolved on an individual site basis. <br />'%. Lot 1, Bl.ock 2 <br />1 . The plat for Ryan Industrial Park indicates a 20 foot utility easement running <br />through this loft (see attached copy). The applicant proposes building directly <br />over this easement. While certain activities (i.e. parking) can occur over <br />easements without problems, allowing construction over an easement should <br />not be a I I owed . <br />2. The St. Paul Water Works requires that a permit be obtained for any activity <br />occurring on property which they own or control . <br />3. The dimensions of the site plan are inconsistent with actual dimensions shown <br />on the final plat for the Industrial Park. According to the applicant, he intends <br />to correct this prior to the September Planning Commission meeting. <br />
