809-3 <br />and reusing the materials in their original form or using them in manufacturing processes that do <br />not cause the destruction of recyclable materials in a manner that precludes further use. <br />(O) Low Density Dwelling Unit. A structure or portion thereof, designated or used <br />predominately for residential occupancy of a continued nature, including single family and <br />duplex dwellings. <br />(P)Yard Waste. Yard waste includes grass clippings, soft-bodied plants, and leaves, <br />and specifically excludes brush, limbs, recyclables and mixed municipal solid waste. <br />809.030. LICENSING. Any person or company intending to collect or dispose of mixed <br />municipal solid waste or recyclable materials within the City of Little Canada shall first apply for <br />and secure a license from the City. This would include those companies conducting a <br />construction roll-off business. The application shall include the following information: <br />(A)name, phone number, and business address of applicant; <br />(B)a description of the vehicles and equipment to be used in said business; <br />(C)the locations of refuse dumps to be used for disposal of collected refuse; <br />(D)the manner in which such refuse and garbage is to be disposed of; and <br />(E)a general disposal plan in conformity with Minnesota Pollution Control Agency <br />regulations. <br />Said application shall be submitted to the City for investigation. The Public Works <br />Director City Clerk shall determine whether or not the applicant is a responsible individual or <br />company, and whether the applicant possesses the necessary equipment to provide adequate <br />services. The Public Works Director City Clerk shall review any other matters he/she deems <br />pertinent to his/her investigation. If the Public Works Director City Clerk finds that the applicant <br />is entitled to a license, he/she shall indicate his/her approval on the application. <br />The license fee shall be as established by City Council resolution and shall be paid to the <br />City at the time of submitting said application. The license fee for any part of a year shall be the <br />same as for a full year. This annual license shall commence July 1 of each year and is non- <br />transferable. <br />809.040. BOND AND INSURANCE REQUIRED. Each applicant shall, before being <br />granted a license, provide a continuing performance bond in the amount of Three Thousand <br />Dollars ($3,000.00) for the benefit of its customers and of the City. Further, said applicant shall <br />provide a certificate of public liability insurance in the minimum amount of Three Hundred <br />Thousand Dollars ($300,000.00) for any one person injured, and Five Hundred Thousand Dollars <br />($500,000.00) for more than one injury in a single occurrence, and One Hundred Thousand <br />Dollars ($100,000.00) property damage coverage per accident on each and every vehicle used for
