809-4 <br />collection service. <br />809.050.MANDATORY PROVISION OF RECYCLING COLLECTION SERVICES. <br />All licensees providing service to residential dwelling units shall provide for the collection and <br />disposal of recyclable materials, and providing recyclable collection services shall be a condition <br />of the license. On or before the 15th day of each month, the licensee shall file a written <br />statement of total tonnage of recyclable materials and refuse collected by the licensee in the <br />previous month with the City. On or before the 1st day of July of each year, each licensee must <br />provide the City with the name and address of any tri-plex, four-plex, apartment building with <br />five or more dwelling units (low, medium, and high density), condominium or townhouse <br />associations, or mobile manufactured home parks which receive collection service from the <br />licensee. Any additions or deletions to this list of customers shall be reported on or before the <br />15th day of each month. <br />809.060. RESPONSIBILITY OF LICENSED HAULER. <br />(A)No person except a hauler duly licensed by the City shall transport mixed <br />municipal solid waste or recyclables over any street or alley in the City or shall disturb, collect, <br />or in any manner, interfere with mixed municipal solid waste or recyclables placed in containers <br />for collection, or interfere in any manner with containers for mixed municipal solid waste or <br />recyclables. Furthermore, no person shall deposit or cause to be deposited any of the <br />above-described materials into containers for such items on private property unless authorization <br />from the property owner has been obtained. <br />(B)Each collection crew shall adhere to all applicable ordinances of the City and all <br />of the rules, regulations and conditions for mixed municipal solid waste collection as established <br />by any agency of the City, County, State, or Federal agencies. <br />(C)The collection crew shall perform their work in a neat and quiet manner and clean <br />up all mixed municipal solid waste, yard waste, or recyclables spilled in collection under any <br />circumstances. <br />(D)The collection crew shall replace all containers on the boulevard adjoining the <br />curb or in an area designed by the owner for such containers. <br />(E)The hauler understands and agrees that once any mixed municipal solid waste is <br />collected, it is the responsibility of the hauler. The hauler shall hold harmless and indemnify the <br />City for all claims, actions, damages or causes of action of any kind whatsoever, including <br />attorney fees. The hold harmless and indemnification includes all claims involving hazardous <br />waste and materials classified as hazardous according to City, County, State and Federal <br />regulations. <br />809.070.
