U I 112DIM <br />CITY COUNCIL <br />SEPTEMBER 25, 2024 <br />PUBLIC HEARINGS <br />ORDINANCE 899, ENACTING CITY CODE CHAPTER 826 CANNABINOID PRODUCTS <br />The City Clerk stated that cannabinoid products have been legal in Minnesota since July of 2022 which <br />include low dose edibles. She stated that this is a new chapter of the City Code which addresses the <br />licensing of these products. She stated that they have decided not to do buffering for these products. <br />She stated that there are only four stores in Little Canada which sell these products, three of which is <br />just a small portion of their overall business. She suggested an annual license fee of $300, which falls <br />between the tobacco and liquor license fees, running from January l St through December 31 st <br />Mayor Fischer opened the public hearing for comments from the general public. <br />There were no comments from the public. Upon motion by Kwapick, seconded by Gutierrez, the <br />public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />D. Miller asked for confirmation that this would have to be a place of business and not a truck type <br />business. The City Clerk commented that this would apply to retail brick and mortar stores. She stated <br />that she does believe there are special event type permits that could be available but would need to <br />look more into that. <br />Kwapick noted an area that has two section B's. He asked if there should be background checks or <br />additional information to determine if there have been any issues. The City Clerk confirmed that she <br />completes background checks and obtain personal information to do that research. She noted that <br />outside of one business, the other businesses possess multiple licenses which already require <br />background checks as well. <br />Gutierrez stated that there are many restaurants and bars that sell THC drinks in their establishments <br />and asked if that would not be allowed in Little Canada, as the ordinance prohibits consumption of the <br />products. The City Clerk clarified that language prohibits a customer from opening a package and <br />eating it within the retail establishment. She stated that she can look into it more to see how cities are <br />handling the consumption within the bar. <br />D. Miller asked if a bar would need to purchase a license of this type or whether it would fall under <br />their liquor license. The City Clerk stated that the Council could table this for tonight or could remove <br />that language. The City Administrator recommended tabling this to allow additional research on that <br />item rather than amending this. D. Miller stated that liquor stores also offer samples at times, and <br />could do that with THC beverages. <br />T. Miller introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2 024-9-106 — TABLING CONSIDERA TION OF ORDINANCE 899 <br />UNTIL ADDITIONAL CLARIFICATION IS GAINED. <br />The foregoing resolution was duly seconded by D. Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />4 <br />
