10 | P a g e <br /> <br />Under a typical Site Plan Review process, City Code provides the Community Development Director to <br />permit a deviation in off-street parking if the applicant supplies evidence of sufficient parking through a <br />parking study. The applicant provided a professional parking study which is attached (Attachment 5). The <br />study finds that the applicant’s proposed parking is sufficient. The proposed ratio of parking spaces per <br />unit is greater than both the ITE estimate of peak parking demand as well as the observed demand found <br />at many nearby apartments. <br /> <br />The applicant is also requesting deviations for a parking area and driveway setbacks. The applicant is <br />proposing a shared driveway from Rice Street which runs across Lot 1 and 2’s side property lines, <br />requiring a deviation from the setback requirement. <br /> <br />The applicant is also requesting that the existing off-street parking areas along Rice Street and Demont <br />remain where they currently are, which are five (5) feet from the property rather than the ten (10) feet <br />regularly allowed in the C-2 Corridor Mixed district. Staff reviewed nearby parcels to the north and south <br />and found that most remain in legal non-conformity with this setback requirement, many with a 0-foot <br />setback from their front property line. <br /> <br />Due to the site layout, the applicant would lose and be unable to replace nine (9) parking spaces if this <br />setback was strictly enforced on Lot 1 and ten (10) parking spaces on Lot 2. The parking areas also <br />technically have 0-foot setbacks along the rear property line of Lot 2 where the designated parking for <br />Flameburger is located (Figure 2, shown in the Residential Density section). <br /> <br />Table 6. Flameburger’s trash area/dumpster is proposed in the rear of its building (eastern side) in <br />the shared off-street lot. The apartment’s trash area is proposed to be near the entrance to the parking <br />garage. <br /> <br />Items to be Addressed: 1.) The proposed deviation in parking spaces should be reviewed and considered <br />by the Council. The Council could request that the applicant create a shared parking agreement with the <br />Flameburger parcel to ensure that additional overflow parking is available. 2.) The proposed deviations <br />in parking area and driveway setbacks should be reviewed and considered by the Council. 3.) The <br />applicant must record a shared access and maintenance agreement for the shared driveway and eastern <br />parking lot. <br />
