MINUTES City Council (Cont'd.) March 12, 1980 Jenny The City Attorney reported that Mrs. Jenny Costa is concerned that Costa Ditch 4P7 is entirely on her property. It was her understanding that Concerns the ditch was to be partially on her property and partially on the Auge property. Mrs. Costa has expressed concern that she was paid only for the ditch being partially on her property and only got half of the amount of money she should have. The Attorney stated that the City Engineer has informed him that the ditch is entirely within the easement that the City purchased from her. Attorney Parks stated that he talked to Mrs. Costa's lawyer and was told that Mrs. Costa feels she was either led to believe what was not the facts, or else someone moved the stakes and the ditch is not where it should have been located. The Attorney also reported that Mrs. Costa is getting some flooding in her back yard, and she feels the ditch should be cleaned out. The Attorney is recommed~rng that by cleaning out the ditch a lot of hard feelings would be alleviated. Councilman DeBace stated that he felt cleaning the ditches would not make much difference. DeBace stated that the culverts are not large enough to handle the water. Councilman Nadeau stated that when this property develops, the drainage problems of the area should be resolved. Councilman DeBace stated that he would meet with the Engineer and Roger Glanzer to take a look at the situation and see what the problem could be. Attorney Parks stated that Mrs. Costa's lawyer is still looking for some type of fence to be constructed between her property and the Stenger property, and also some type of method for diverting the water from the Stenger property before it runs onto the Costa property. Another thing Mrs. Costa's lawyer mentioned was that the blacktop from the Stenger parking lot is encroaching on the Costa property. Parks also mentioned that the Stenger building is misplaced on the property. Perhaps Mr. Stenger will be willing to make some concessions to Mrs. Costa due to the mislocation of his building. Senior Attorney Parks reported that Mr. McNamara and Mr. Jacobsen are willing Citizen to grant the City a temporary option on the Jackson and Little Canada Housing Road property that the City is considering fora senior citizen housing Development development. Steve Rice from the Community Development Corporation has indicated that he will accept this temporary option. Parks also reported that Mr. Rice has begun the application process for the funding of the senior citizen housing development. Page -12-
