<br /> MINUTES <br /> City Council <br /> (Cont'd.) <br /> March 12, 1980 <br /> Jenny The City Attorney reported that Mrs. Jenny Costa is concerned that <br /> Costa Ditch 4P7 is entirely on her property. It was her understanding that <br /> Concerns the ditch was to be partially on her property and partially on the Auge <br /> property. Mrs. Costa has expressed concern that she was paid only for <br /> the ditch being partially on her property and only got half of the <br /> amount of money she should have. <br /> The Attorney stated that the City Engineer has informed him that the <br /> ditch is entirely within the easement that the City purchased from her. <br /> Attorney Parks stated that he talked to Mrs. Costa's lawyer and was told <br /> that Mrs. Costa feels she was either led to believe what was not the <br /> facts, or else someone moved the stakes and the ditch is not where it <br /> should have been located. <br /> The Attorney also reported that Mrs. Costa is getting some flooding in <br /> her back yard, and she feels the ditch should be cleaned out. The <br /> Attorney is recommed~rng that by cleaning out the ditch a lot of hard <br /> feelings would be alleviated. <br /> Councilman DeBace stated that he felt cleaning the ditches would not <br /> make much difference. DeBace stated that the culverts are not large <br /> enough to handle the water. <br /> Councilman Nadeau stated that when this property develops, the drainage <br /> problems of the area should be resolved. <br /> Councilman DeBace stated that he would meet with the Engineer and Roger <br /> Glanzer to take a look at the situation and see what the problem could be. <br /> Attorney Parks stated that Mrs. Costa's lawyer is still looking for some <br /> type of fence to be constructed between her property and the Stenger <br /> property, and also some type of method for diverting the water from <br /> the Stenger property before it runs onto the Costa property. Another <br /> thing Mrs. Costa's lawyer mentioned was that the blacktop from the <br /> Stenger parking lot is encroaching on the Costa property. <br /> Parks also mentioned that the Stenger building is misplaced on the <br /> property. Perhaps Mr. Stenger will be willing to make some concessions <br /> to Mrs. Costa due to the mislocation of his building. <br /> Senior Attorney Parks reported that Mr. McNamara and Mr. Jacobsen are willing <br /> Citizen to grant the City a temporary option on the Jackson and Little Canada <br /> Housing Road property that the City is considering fora senior citizen housing <br /> Development development. Steve Rice from the Community Development Corporation has <br /> indicated that he will accept this temporary option. Parks also reported <br /> that Mr. Rice has begun the application process for the funding of the <br /> senior citizen housing development. <br /> Page -12- <br /> <br />
