<br /> MIPIUTES <br /> CITY COUNCIL <br /> (Cont'd.) <br /> March 12, 1980 <br /> Councilwoman Scalze informed Mr. Sowdow that the Council discussed this <br /> letter with Mr. Flammond. <br /> Councilman Fahey stated that Mr. Hammond is giving the City a major <br /> portion of his property for drainage. Fahey also told Mr. Sowdow that <br /> Mr. Flammond will be filling the property on the east and the west and <br /> there will be drainage between the filled portions, <br /> Mr. Sowdow told the Council that he was at a meeting of the Watershed <br /> District at which they told Mr. Flammond he could fill the westerly <br /> portion of his property, but not the easterly 1/2 of the property. <br /> Councilman DeBace informed Mr. Sowdow that Council will be taking care <br /> of the drainage on B-2 and will be getting an easement from Mr. Hammond <br /> to take care of the pond and drainage ditch on his property. DeBace <br /> also stated that the Council made Mr. Hammond aware that he should not <br /> run any water onto the Sowdow property. <br /> Mr. Sowdow stated that he did agree that as long as the Flammond property <br /> is tapered so as not to run any water onto him and the drainage problems <br /> in the area are corrected, the filling was 0.1<. with him. However, <br /> Mr. Sowdow stated, there are some other problems which have come up. <br /> Mr. Sowdow stated that since the flood a couple of years ago, his house <br /> is in a weakened condition. It has come to Mr. Sowdow's attention that <br /> Mr. Flammond will have to build his house on pilings. These pilings <br /> will have to be installed at a depth of 35 feet. Mr. Sowdow is concerned <br /> that the pressure from driving the pilings will damage his home. Sowdow <br /> commented that he feels it will be the responsibility of the City and <br /> Mr. Flammond for any damage that would result to his home from these <br /> pilings. <br /> Attorney Parks stated that it was his opinion that this would be a <br /> personal matter between Mr. Hammond and Mr. Sowdow. <br /> Mr. Nadeau stated that pilings were driven for some of the houses on <br /> Carla Lane, and to his knowledge no damages occurred to neighboring <br /> homes. <br /> Councilman Fahey suggested that maybe Mr. Flammond should include in his <br /> hold harmless agreement with the City any damages from hydrostatic <br /> pressure and pilings. <br /> Mrs. Mugs Nardini, another property owner on County Road 6-2, asked <br /> the Council how Mr. Hammond can be allowed to raise his property <br /> h 1/2 feet without causing the neighborhood to be ruined. Mrs. Nardini <br /> stated that the Watershed District has not given Mr. Hammond permission <br /> to taper the fill away from the house. <br /> Councilman Fahey stated that Mr. Hammond would be tapering away from the <br /> house, but by the time he gets to the Sowdow's property, he wouldn't be <br /> any higher. <br /> Councilman DeBace stated that the City would be cleaning the ditches and <br /> pond to take care of any additional run-off. <br /> Page -7- <br /> <br />
