<br /> MINUTES <br /> City Council <br /> (Cont'd.) <br /> March 12, 1980 <br /> Mr. Sowdow suggested that the ditches and the pond be cleaned out before <br /> any of the filling activity begins. Mr. Sowdow said that the ditch is <br /> full in front of his house, and should we get a heavy rain, his yard <br /> would become a holding pond. <br /> Councilman Fahey stated that the City should clean the ditches and <br /> holding pond now. <br /> Mrs. Scalze stated that she heard the Flrir~y Corps of Engineers is against <br /> the filling of the Hammond property. <br /> Mrs. Nardini again pointed out that the Watershed District denied the <br /> filling of the easterly one-half of the Hammond Property. Mrs. Scalze <br /> stated that the Council granted Mr. Flammond a fill permit and he was <br /> to comply with whatever the Watershed District required. P4r. Nadeau <br /> corrected Mrs. Scalze's statement in that it was Mr. Sprosty who was <br /> to comply with 'the Watershed District's recommendations. <br /> Mr. Fahey stated that the City should authorize the cleaning of the ditches <br /> and the pond to get underway immediately. Mrs. Scalze stated that the <br /> Council has authorized the Engineer to advertise for bids on the work. <br /> Mr. Sowdow informed the Council that he was advised by a contractor that <br /> his house would go from the driving of pilings within 50 feet of his house. <br /> Mr. Fahey stated that he was not aware of the pile driving to be done. <br /> Fahey suggested that the Flttorney be instructed to inform Mr. Flammond <br /> that one of the requirements of the hold harmless is that the City <br /> be held harmless from pile driving and that the City ask Mr. Flammond <br /> to meet with Mr. Sowdow regarding the pile driving. <br /> Mr. Sowdow stated that either Mr. Hammond or the contractor driving the <br /> pilings should be liable for damages to his house. <br /> Mr. Nadeau stated that if there was damage done to the Sowdow house, <br /> Mr. Flammond would be liable for it because it was a result of the <br /> construction. <br /> Mrs. Nardini asked what this hold harmless agreement was. Councilman <br /> Fahey stated that the hold harmless agreement was just to protect the <br /> City from any defense costs that could arise in a suit. The City <br /> would probably not be liable for anything resulting from the Flammond <br /> landfilling, but the City does not want to have to pay defense costs <br /> should they be named in a suit. <br /> Mr. Sowdow stated that he wanted the minutes to show that the County <br /> Board was not aware of 'the fact that pilings would be used in the <br /> construction of the Flammond house. Mr. Sowdow asked the Council why <br /> they issued a permit to Mr. Hammond not knowing pilings would be used <br /> and the effect they could have on surrounding homeowners. <br /> Page -8- <br /> <br />
