<br /> MINUTES <br /> ity you cil <br /> ~Cont d.~ <br /> March 12, 1980 <br /> Mr. Sowdow asked the Council vdhy they passed the permit without knowing <br /> what the Watershed District's recommendations were, and without seeing <br /> a report on the pile driving. <br /> Councilman DeBace stated that he felt if there would be a problem with <br /> possible damage to surrounding homes from the pile driving, the report <br /> the City has on file regarding the pile driving would make reference <br /> to it. <br /> Attorney Parks stated that Mr. Sowdow and Mrs. Nardini are trying to get <br /> at a problem before it happens because after may be too late. If the <br /> Sowdow's or Nardini's would have to make a claim for damages <br /> caused by the construction of the Flammond property, in dealing with <br /> an insurance company their claim may be denied. P4r. Parks stated <br /> that subterranean changes that could result from the pile driving <br /> on the Flammond property are equally as important as the drainage problems <br /> of 'the area. The Council should consider what can be done to protect <br /> these people. <br /> Mr. Fahey stated that in light of the pile driving he felt it would not <br /> be unreasonable to require Mr. Flammond to put up a bond to protect these <br /> people until the completion of the project. <br /> Councilman Nadeau suggested that perhaps Mr. Hammond should attend the <br /> next Council meeting to discuss the situation. <br /> Mr. DeBace suggested that Mr. Flammond request Twin City Testing to make <br /> some recommendations on the possibility of damages to surrounding <br /> properties as a result of the pile driving. <br /> Mr. Sowdow stated that he knows Mr. Hammond will cooperate. <br /> Mrs. Nardini asked if the City should investigate the possibility of <br /> purchasing that property from Mr. Flammond. <br /> Mr. Len Pearson of 651 East County Road B-2 appeared before the Council. <br /> Mr. Pearson suggested that the City purchase the Flammond property. <br /> Pearson stated that the property should remain a swamp area to act as <br /> a filter for the water going into Lake Gervais. <br /> Mayor Hanson stated that the City requested the County to consider <br /> purchasing the Turnquist property, and they refused. If the City <br /> were to put a piece of property to a referendum for its purchase, <br /> Mayor Hanson feels the citizens would vote it down. Mrs. Scalze <br /> stated that the County has an active parks and open space program, <br /> and the County is the one that should be buying the Hammond property. <br /> Councilman Nadeau stated that the only answer to the drainage problems <br /> in the County Road B-2 area is to get the water to exit on the south <br /> side of Lake Phalen. <br /> Page -9- <br /> <br />
