Under <br /> paragraph G on that same page "any" is to be added in front of the <br /> words "City staff", and the sentence "Failure by the Planning Commission <br /> to reach a decision within the time limit shall be deemed as a denial <br /> of the request." should be added to the end of that paragraph. <br /> Page 63 K. the sentence "In addition, the Council may specify a time <br /> limit for the permit at the end of which time the applicant shall reapply <br /> for the conditional use permit in accordance with the terms of this <br /> Section." will be added. Under L. of that same page "at least four <br /> affirmative votes" should be substituted for "a four-fifths (4/5) vote". <br /> Under paragraph 921.020 on page 63 the words "his own" shall be substituted <br /> for "the said" and the sentence "All amendment requests shall comply with <br /> the procedures set forth in Section 921.010" shall be added to the end of <br /> the paragraph. <br /> On page 65 of the Ordinance under paragraph D. a point 5. should be added <br /> which reads "Any bond or security which has been forfeited to the City as <br /> a result of failure by the applicant to comply with the conditions of the <br /> conditional use permit or the Ordinances of the City shall be deposited <br /> in the Little Canada General Fund." Some additional performance bond <br /> provisions were added directly after point D. Also a paragraph E. was <br /> added to this page dealing with conditional use permit revocation. <br /> Mr. Nielson reported that on page 66 paragraph C. was rewritten as it <br /> was poorly worded and the term "insufficient area" was added under 2. of <br /> paragraph C. This makes paragraph more clear. <br /> The Attorney stated that there should be something in paragraph C which <br /> deals with hardship. Councilman Fahey suggested adding the phrase <br /> %and which constitute a unique hardship in the reasonable use of the <br /> specific parcel involved" to the end of paragraph A. Fahey then suggested <br /> that perhaps the Ordinance should deal with hardships under a separate <br /> point. The Attorney suggested a point e. after point d. in this section. <br /> The Planner suggested it read, "A genuine hardship exists in complying <br /> with the Ordinance." <br /> On page 67 paragraph Q. is deleted and subsequent numbering will be <br /> changed. Under paragraph F. of that same page a sentence will be inserted <br /> dealing with the failure of the Planning Commission to act on a request <br /> deems denial of the request. Also the word "the" before "City staff's" <br /> should be changed to "any". In paragraph G on this same page the Planner <br /> added the phrase "at least 10 days prior to the hearing". Paragraph J <br /> on page 67 was changed to require four affirmative votes of the Council. <br /> On page 68 Planner added some provisions to 'the section on performance <br /> bond. <br /> On Page 71 under the second paragraph of section L, the word "his" should <br /> be changed to "this". On the same page under section M. the phrase "not <br /> including side yard setbacks" should be added to the end of 2. <br /> Page -8- <br /> <br />
