MINUTES <br /> City Council <br /> (Cont.) <br /> May 1~4, 19F30 <br /> Mr. Nadeau introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. f30-5-170 - APPROVING THE REC~UEST BY MR. <br /> JOSEPH BUCIIE TO HOOK UP TO LITTLE CANADA SE6dER AND WATER <br /> FROM LOTS l9 THROUGH 22 ON PARK STREET CONTINGENT UPON <br /> MR, RUCHE'S SIGNING AN AGREEMENT TFIA7 NOT GIITFISTANDING THE <br /> APPROVAL TO FIOOK UP TO CITY SE6JER AND WATER MR. RUCHE VdILL <br /> BE ASSESSED FOR SEWER AND WATER IF AND WHEN PARK STREET <br /> GOES THROUGI-i AND FURTHER REClUIRING THAT MR. BUCFIE PAY <br /> FIOOK UP CFIARGES <br /> The foregoing resolution was duly seconded by P9r. DeBace. <br /> Ayes (5) Nadeau, DeBace, Fahey, fianson, Scalze. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Rasolution Bool< No. 6, Page 110. <br /> <br /> Frank Lang Mr. Frank Lang of 24.39-2~E41 McMenemy appeared before the Council. <br /> Mr.. Lang had a couple of concerns he wanted to discuss with 'the Council. <br /> Mr. Lang is concerned with the filling that a Mr. Frank Jones has been <br /> doing on his property. The City Clerk reported that Mr. Jones does not <br /> have a permit to be Pilling his property. Mr. Jones has been informed <br /> that he is in violation of the City's filling ordinances. Mr. Jones <br /> will be removing the fill that he put i.n. The Clerk informed Mr. Jones <br /> that if the fill was noi: removed his house would be red-tagged. <br /> Councilwoman Scalze stated that the City's ordinance does not have an <br /> enforcement clause in it. .The City Attorney stated that tha ordinance <br /> does not need a penalty clause. Violations of the ordinance are a <br /> misdemeanor. Also before any filling is done, the Engineer should be <br /> examining the plans for the filling, and the Attorney must examine <br /> the plans for the type of fill going into a property, so that this <br /> information can be marked on the abstract of the property. <br /> Councilman Fahey suggested that the City Clerk send a letter to Mr. <br /> Jones documenting their conversation. The Clerk stated that he would <br /> send the letter by both certified mail and by the regular mails. <br /> Mr. Lang's second concern was the activities of Mr. Pugaczewski in <br /> the grading of his property. The property has not been seeded or soled <br /> and Mr. Lang has a great deal of dirt blowing over onto his property <br /> from the Pugaczewski property. <br /> The Attorney stated that the City can require that Mr. Pugaczewski <br /> either seed or sod his property. <br /> Page -6- <br /> <br />
