<br /> MINUTES <br /> CITY Council <br /> June 11, 1980 <br /> The Attorney reported that it was his feeling that this was a private <br /> matter between the Lang's and Pugaczewski's and the City should not <br /> be involved. <br /> Molted The Attorney reported that he found that years ago Ditch 16 was Gervais <br /> Matter Creek. The County took over this creek as ditch X16 several years ago. <br /> The Attorney stated that when the ditch was cleaned, the City tried <br /> to get a construction easement from Mr. Molted, but Mr. Molted would <br /> not grant the easement as he wanted the direction of the ditch changed <br /> and the City would not do it. Therefore, the City went on the Mosted <br /> property and cleaned the ditch without an easement. <br /> The Attorney stated that the statutes of limitation has run out on any <br /> trespassing violations the City may have made. <br /> Parks further reported that when he informed Mr. Mosted that the City <br /> could not do anything for him, Mr. Mosted informed him that he would <br /> see the City in court. <br /> Parks stated that he will inform Mr. Mosted's attorney of the situation. <br /> Councilman Fahey stated that if Mr. Mosted sues the City, the City can <br /> claim the suit was brought in bad faith and try to recoup its attorney <br /> fees. <br /> Condominium The City Clerk reported that the Planning Commission must review the <br /> Ordinance Condominium Ordinance before the Council should act on it. <br /> Land Fill The Attorney suggested that the Council develop a land fill ordinance <br /> Ordinance that will take care of the City's needs for the next 1D to 15 years. <br /> Parks suggested that he and the City Planner get together to work <br /> up this ordinance. <br /> Councilman Nadeau informed Council that Mr. Schaffer on Lake Street <br /> is doing some filling without a permit. Nadeau asked that Mr. Schaffer <br /> be sent a letter regarding this violation. <br /> Frank Mayor Flanson reported that the Building Inspector red-tagged Frank <br /> Jones Jones' house and this forced Mr. Jones to remove the fill which he <br /> Property illegally dumped on the property. <br /> Costa- The Attorney reported that Mr. Stenger has contacted Mrs. Costa and <br /> Stenger has made some offers to her for solving their problems. Mr. Stenger <br /> Matter is letting Mrs. Costa think about the offers. <br /> The Attorney stated that he informed Mrs. Costa and Mr. Stenger that <br /> their's was a private problem and the City was not involved. The only <br /> problem is that the Stenger building does not sit where it should and <br /> the City could be drawn in on a lawsuit for that reason.
