MINUTES <br /> City Council <br /> July 9, 1980 <br /> Attorney Parks stated that there could be a problem in prosecuting <br /> someone for violating the park closed hours with the proposed ordinance. <br /> It would be necessary to call in experts to testify as 'to the exact <br /> minute of sunset or sunrise. Parks stated that he was involved in just <br /> such a case where a person was acquitted when an expert was not called <br /> in. <br /> Councilwoman Scalze stated that this was the same method that the County <br /> used for their parks. <br /> Mayor Hanson suggested that this be referred to the Park Commission for <br /> their recommendations. <br /> Councilman Fahey stated that he was strongly opposed to this ordinance. <br /> Land Fill Attorney Parks informed the Council that he would be meeting with the <br /> Ordinance City Planner regarding a land fill ordinance. <br /> Condominium Councilwoman Scalze stated that the Planning Commission has recommended <br /> Ordinance approval of the Condominium Ordinance. <br /> #168 <br /> Mrs. Scalze introduced the following ordinance and moved its adoption: <br /> ORDINANCE N0. 168 - CONDOMINIUM ORDINANCE <br /> The foregoing ordinance was duly seconded by Mr. Fahey. <br /> Ayes (5) Scalze, Fahey, Nadeau, DeBace, Hanson. <br /> Nayes (0). <br /> Ordinance declared adopted. <br /> This ordinance appears in Resolution Book No. 6, Page 167. <br /> Clyde Attorney Parks stated that he has inspected the Hoffman property. In <br /> Hoffman the Attorney's opinion Mr. Hoffman has complied with the order to clean <br /> <br /> Matter up his property. There are still a few things around the property, <br /> but the situation is much improved. <br /> Parks stated that Mr. Hoffman is scheduled to appear in court on Monday. <br /> Lang & Attorney Parks stated that Mr. Pugaczewski is still working on his back <br /> Pugaczewski yard. Parks stated that he feels Mr. Pugaczewski has done what he agreed <br /> <br /> Matter to do a year ago. Both the Lang's and Pugaczewski's agree that there is <br /> no erosion into the Lang property. <br /> Mrs. Lang feel Mr. Pugaczewski has interfered with the natural water flow <br /> through the back yards. Parks stated that he does not agree, and even <br /> if it was disturbed, Pugaczewski has this right. <br /> Parks stated that in his opinion this was a neighborhood fued. Fle has <br /> informed Mrs. Lang that Mr. Pugaczewski is not in violation of any <br /> ordinances. <br /> Page -15- <br /> <br />
