<br /> MINUTES <br /> City Council <br /> <br /> July 9, 1980 <br /> The foregoing resolution was duly seconded by Mr. Fahey. <br /> Ayes (5) Nadeau, Fahey, Flanson, DeBace, Scalze. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 167. <br /> Planning The Planning Commission has referred the matter of attendance of its <br /> Commission members to the Council for their attention. The Commission would like <br /> Members' a letter sent to some of its members from the Council regarding their <br /> Attendance attendance. <br /> Councilman Fahey instructed the City Clerk to send a letter to Mr. Boss <br /> and Mr. Winiecki regarding their poor attendance at Planning Commission <br /> meetings. <br /> City Garage The City Engineer submitted to the Council a change order in the amount <br /> Change of $556.00 for insulating the interior wall in the garage separating the <br /> Order heated area from the non-heated area. <br /> No . 2 <br /> Mr. DeBace introduced the following resolution and moved its adoption: <br /> RESOLUTIONI N0. 80-7-261 - APPROVING CHANGE ORDER N0. 2 <br /> FOR THE CITY GARAGE IN THE AMOUNT OF $556.00 <br /> The foregoing resolution was duly seconded by Mrs. Scalze. <br /> ayes (5) DeBace, Scalze, Hanson, Nadeau, Fahey. <br /> Nayes (0 <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 168. <br /> Final The Engineer recommended that final payment be made to Montgomery <br /> Payment Construction in the amount of $9,325.37for the Ruth Street improvement. <br /> Montgomery The Engineer reminded Council that this was the improvement where a <br /> Construction lawsuit may be pending by Rocky Waite. The contractor's bond will be <br /> in force for a year on the project. <br /> Councilman DeBace stated that he had some information that may be helpful <br /> if a lawsuit is filed. The Attorney suggested that he and Mr. DeBace <br /> get together and discuss this information. <br /> Mr. DeBace introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 80-7-262 - ACCEPTING IMPROVEMENTS N0. 78-8 and <br /> 78-15 AND ORDERING THE FINAL PAYMENT BE MADE TO MONTGOMERY <br /> CONSTRUCTION IN TFIE AMOUNT OF $9,325.37 AND INSTRUCTING THAT <br /> A LETTER BE SENT TO MONTGOMERY CONSTRUCTION INFORMING THEM Of <br /> A POSSIBLE LAWSUIT PENDING ON THIS IMPROVEMENT <br /> The foregoing resolution was duly seconded by Mr. Nadeau. <br /> Ayes (5) DeBace, Nadeau, Scalze, Hanson, Fahey. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 168. <br /> Page -18- <br /> <br />
