<br /> MINUTES <br /> City Council <br /> August 13, 1980 <br /> The Mayor suggested that perhaps the size of the lots to be filled <br /> should be addressed in the t.and Fill Ordinance. <br /> Councilman Fahey also suggested that the excavation caused by new <br /> construction should be excluded from requirement of a permit. Fahey <br /> also suggested that perhaps a permit should be required for all filling. <br /> The Attorney commented that the City might end up with a major land fill <br /> permit and a minor fill permit. <br /> Fahey suggested that in all cases the permit have a fee to cover Engineer's <br /> costs that might be involved. <br /> Mrs. Scalze asked if there would be a penalty under the ordinance. <br /> The Attorney stated that any violation of the ordinance would be a <br /> misdemeanor. <br /> Last Chance Council decided to discuss the situation at the Last Chance Saloon. Mr. <br /> Saloon Joseph Saad, the owner, was not present at the meeting. <br /> Mayor Hanson stated that he looked at the premises of the Last Chance <br /> Saloon. Hanson further stated that the complaints the Council has <br /> received about the parking lot and fence are valid ones. <br /> Hanson stated that he spoke to Mr. Saad about these problems and directed <br /> him to clean up the premises. Mr. Saad did clean up the parking lot, but <br /> upon Mr. Hanson's rechecking the lot he found the condition to be just <br /> as bad as before. Mr. Hanson stated that he does not feel Mr. Saad is <br /> cooporating 100%. <br /> Mayor Hanson also commented that he is concerned about communications <br /> between the City and the Sheriff's Department. Mr. Hanson felt the <br /> Sheriff's Department is not properly patrolling the Last Chance Saloon. <br /> Councilman Fahey felt that the Last Chance Saloon should have guards <br /> as Hoggsbreath was required to hire. Fahey also felt that the Last <br /> Chance Saloon should be cited for the condition of disrepair of the <br /> property. Fahey felt Mr. Saad should also be notified that if corrective <br /> action is not taken immediately the City will find this grounds for <br /> suspension of his liquor license. Fahey also felt that Mr. Saad should <br /> be notified to come to the Council and present evidence that security <br /> guards have been hired. <br /> Mayor Hanson stated that Mr. Saad should also be required to show cause <br /> as to why he did not appear before the Council tonight as he was requested <br /> to do. <br /> The City Attorney informed Council that Mr. Saad should be entitled to <br /> a hearing before the City could take his license. <br /> Councilman Fahey suggested that a letter be sent to Mr. Saad stating that <br /> corrective measures should be taken by the next Council meeting or the <br /> City will start procedures against him. <br /> Page -16- <br /> <br />
