<br /> MINUTES <br /> City Council <br /> August 13, 1980 <br /> The tennis courts would be open until 11 P.M. <br /> Councilman Fahey stated that he was still opposed to these park hours. <br /> Mrs. Scalze introduced the following ordinance and moved its adoption: <br /> ORDINANCE #169 - AMENDING CHAPTER 260 OF THE LITTLE CANADA <br /> CODE, SECTION 2601.030 BY CHANGING THE OPEN HOURS OF ONE-FIALF <br /> FIOUR BEFORE SUNRISE AND TO ONE-HALF HOUR AFTER SUNSET <br /> The foregoing ordinance was duly seconded by Mr. Nadeau. <br /> ayes (4) Scalze, Nadeau, Hanson, DeBace. <br /> Nayes (1) Fahey. <br /> Ordinance declared adopted. <br /> This ordinance appears in Resolution Book No. 6, page 199. <br /> Planning Mrs. Scalze reported that the Park Commission has asked to receive copies <br /> Commission of the Planning Commission minutes. <br /> Minutes <br /> Mr. Hanson introduced the following resolution and moved its adoption: <br /> RESOLUTION PIO. 80-8-311 -REQUESTING THAT TFIE RECORDING <br /> SECRETARY OF THE PLANNING COMMISSION SEND COPIES OF THE <br /> PLANNING COMMISSION MINUTES TO TFIE PARK COMMISSIONI <br /> THE foregoing resolution was duly seconded by Mrs. Scalze. <br /> Ayes (5) Hanson, Scalze, DeBace> Fahey> Nadeau. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 200. <br /> Fencing In Mrs. Scalze reported that the Park Commission is currently discussing <br /> Spooner with the School District a proposal for installing fences along Eli <br /> Park Road from the school parking lot up to the park entrance and from <br /> south border of the school parking lot. They are hoping this will <br /> decrease damage caused by cars. <br /> State Law The Attorney reported that the City's park dedication ordinance is not <br /> Regarding in compliance with State law. The City's ordinance will have to be <br /> Park changed. Parks reported that it will have to comply with the State <br /> Dedication law regarding the value of property. Parks also reported that this <br /> change in the State law was just recently made. <br /> The Attorney also reported that the State law says cities cannot demand <br /> these fees from industrial property as they do not create use for or <br /> need parks. <br /> The Attorney also stated that under a PUD or a subdivision such fees <br /> can be demanded. <br /> The Attorney stated that he will re-read the State law and give the <br /> Council an opinion on it. <br /> Page -21- <br /> <br />
