<br /> MINUTES <br /> CITY COUNCIL <br /> September 8, 1980 <br /> Public Improvement No. 78-15 is the improvement of Ruth Street from Demont to <br /> Hearing County Road C by sewer, water, and street construction. <br /> Improvement <br /> No. 78-15 The Engineer reported that there is a problem with the assessments on <br /> the corners of proposed Lake Street. The Engineer suggested that this <br /> portion of Lake Street be vacated. Carley stated that these are all <br /> 25 foot lots in this area and he assessed the sides of the lots <br /> whieh would form the corners of Lake Street. <br /> Property owners in the area also pointed out to the Council that some <br /> land-locked property has been assessed for this improvement. The <br /> property owners asked that these assessments be deferred until such <br /> time as the property has access. <br /> The Engineer agreed that these lots should not be assessed. <br /> One of the property owners in the area asked if there was an extra charge <br /> for the road having to be raised when the project went in. The property <br /> owner felt the cost should be borne by the contractor and not assessed <br /> to the property owners. <br /> Councilman DeBace stated that to his knowledge the contractor paid <br /> this cost. The Engineer stated that he would check this out. <br /> Mr. Fahey introduced 'the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-9-340 - CLOSING THE PUBLIC HEARING ON <br /> IMPROVEMENT NO. 78-15 <br /> The foregoing resolution was duly seconded by Mr. Nadeau. <br /> ayes (5) Fahey, Nadeau, Hanson, Scalze, DeBace. <br /> Hayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 223. <br /> Mr. Fahey introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-9-341 - APPROVING AND ADOPTING THE ASSESSMENT <br /> ROLL FOR IMPROVEMENT N0. 78-15, AUD. NO. 1837, D/P N0. 1837 WITH <br /> THE FOLLOWING CHANGES: ThiE ROAD AND SEWER ASSESSMENTS FOR LOT 48, <br /> BLOCK 2 SHOULD BE DELETED; LOTS 1, 2, 3, 4, AND 5, BLOCK 2 SHOULD <br /> HAVE THE SEWER ASSESSMENT. DELETED;. BUT SHOULD BE ASSESSED FOR 134 <br /> FEET OF WATERMAIN IMPROVEMENT; THE ASSESSMENTS FOR LOT 35, BLOCK <br /> 2 SHOULD BE DEFERRED; THE ASSESSMENTS FOR LOTS 33 AND 34, BLOCK 2 <br /> SHOULD BE DEFERRED; THE ASSESSMENTS FOR LOTS 1, 2, 3, 47, AND 48, <br /> BLOCK 12 SHOULD BE DEFERRED; THE ASSESSMENTS FOR LOTS 1, 2, 3, <br /> BLOCK 12 SHOULD BE REDUCED BY 30 FEET FOR THE PROPERTY ENCOMPASSED <br /> BY LAKE STREET AND THIS AMOUNT SHOULD BE ASSESSED TO THE CITY AND <br /> DEFERRED; THE ASSESSMENTS FOR LOTS 33 AND 34, BLOCK 2 SHOULD BE <br /> REDUCED BY 30 FEET FOR THE PROPERTY ENCOMPASSED BY LAKE STREET AND <br /> ThIIS AMOUNT SHOULD BE ASSESSED TO THE CITY AND DEFERRED; THE <br /> ASSESSMENTS FOR LOTS 5, 6, 7, 8, 9, AND 10, BLOCK 13 SHOULD BE <br /> REDUCED BY 30 FEET FOR THE PROPERTY ENCOMPASSED BY LAKE STREET <br /> AND THIS AMOUNT SHOULD BE ASSESSED TO THE CITY AND DEFERRED; Page -13- <br /> <br />
