<br /> MINUTES <br /> CITY COUNCIL <br /> September 10, 1980 <br /> The foregoing resolution was duly seconded by Mr. Hanson. <br /> Ayes (5) Scalze, Hanson, DeBace, Nadeau, Fahey. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 231. <br /> Mr. Paul Borg commented to the Council that variances have been granted <br /> on surrounding property in the area of his home, which he feels have <br /> set this area apart from the typical R-1 neighborhood. <br /> Councilman DeBace stated that he has no objection to the change in zoning <br /> as long as the whole area is rezoned. <br /> Councilwoman Scalze stated that she feels this is a small piece of property <br /> on which to build a tri-plex with the amount of blacktop that would be <br /> necessary and the number of cars that would be involved. <br /> Councilman DeBace commented that Mr. DeLaurias is not opposed as long as <br /> the street is improved and he gets sewer and water to his house. <br /> Councilman Nadeau stated that the City could probably get an easement from <br /> St. Jude's for the street, but that St. Jude's would not pay for the <br /> improvement. Councilman Fahey commented that the improvement would not <br /> benefit St. Jude's at all. Fahey also stated that he still had some <br /> reservations about a tri-plex on that property. <br /> Scalze felt that if the road was improved the turn-around should not be <br /> on the DeLaurias property. <br /> Fahey stated that he was opposed to the rezoning unless the whole area <br /> was rezoned. <br /> The Planner stated that if the rezoning were approved, Mr. Borg must <br /> then apply for a special use permit to construct a tri-plex. Then Mr. <br /> Borg must submit plans for the tri-plex. <br /> Fahey felt there were a number of issues the council must address in this <br /> case. Sewer, water and street should be put in, but St. Jude's should <br /> not be assessed. Both Mr. Borg and Mr. DeLaurias would have to dedicate <br /> the necessary easements for the road. The easements for the road would <br /> have to be obtained from St. Jude's with no cost to the City. <br /> The Engineer commented that the street would be a 60 foot right-of-way <br /> with a 30 foot blacktop. <br /> Councilman DeBace put a motion on the floor to approve the rezoning <br /> of the entire piece of property from R-1 to R-2. The motion was seconded <br /> by Mr. Nadeau. The Planner pointed out that in order to rezone the entire <br /> piece of property another public hearing would have to be held as the <br /> public hearing held at the last Council meeting pertained only to the Borg <br /> property. Therefore, the surrounding neighbors would have to be notified. <br /> Council would also have to hold a hearing fora conditional use permit to <br /> construct a tri-plex. <br /> Page -7- <br /> <br />
