Engineer Carley suggested that Cameron
Development could build a dike to prevent the drainage from the State
Highway Department's property from draining onto their property.
Councilman Fahey asked if the Council approved this if the City would
have any liability to the State Flighway Department. The Engineer suggested
that this be checked in to.
The Attorney stated that the City would have no liability unless the dike
interfered with a natural water course. The Attorney further stated that
a pipe is not considered a natural water course.
The Engineer stated that he would like some direction from the Council if
he was to proceed any further with this study.
The Engineer informed the Council that if Cameron Development could divert
the State Highway Department water, the pond on the property would handle
the drainage for the Cameron Development property. Mr. Carley suggested
to Mr. Greckoff that he inform the State Highway Department of what he
plans to do.
Mr. Carley also stated that he feels Cameron Development could get approval
for the first phase of their project at this point. That phase is the
construction of miniwarehouses.
Mr. Greckoff stated that he hoped the City tuould not come back in the future
and require him to construct a pumping station to tal<e care of the State's
water.
Page -14-
