<br /> MINUTES <br /> City Council <br /> `~ctober 8, 1980 <br /> Councilman DeBace stated that if that happened, it would be a City project <br /> with everyone participating in the cost. <br /> Councilman Nadeau suggested that the City be held harmless on the diverting <br /> of the State's water. <br /> Attorney Parks stated that the State does not have the right 'to interfere with <br /> the use of Mr. Greckoff's land. The State can be required to contain their <br /> own water. Mr. Greckoff should, however, inform the State of any plans <br /> for diverting their water. <br /> Mayor Hanson suggested that the Council could give Mr. Greckoff <br /> approval for Phase I and then Mr. Greckoff could start worl<ing with <br /> the Highway Department. Mr. Fahey suggested that this approval be <br /> contingent upon Mr. Greckoff's complying with the Engineer's recommendations. <br /> The Attorney stated that he has prepared the Developer's Agreement for this <br /> PUD. Parks suggested that the Council and Mr. Greckoff take some time <br /> to look over this agreement before taking action on it. <br /> Fahey suggested that approval should be contingent upon 'the signing of <br /> the Developer's Agreement. The Attorney suggested that it be contingent <br /> to approval of the final draft the the Developer's Agreement. <br /> Mr. I-Janson introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-10-394 - APPROVING TFIE GRADING PERMIT FOR <br /> PFIASE I CONTINGENT UPON TI-IE SPECIFICS AS OUTLINED BY TI-IE <br /> ENGINEER WITH REFERENCE TO THE DRAINAGE PROBLEMS WHICH ARE <br /> INDICATED IN THE CONCEPT PLAN OF THE PUD WITH FINAL APPROVAL <br /> CONTINGENT UPON TFIE DEVELOPER'S AGREEMENT <br /> The foregoing resolution was duly seconded by Mr. Nadeau. <br /> Ayes (5) Flanson, Nadeau, Fahey, Scalze, DeBace. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 256. <br /> Cardon Councilwoman Scalze reported that the City of Maplewood is not requiring <br /> Estates holding ponds in the Cardon Estates development because they are not <br /> aware that the City is requiring them. The Engineer reported that the <br /> Maplewood Engineer is aware of this. <br /> Scalze stated that she would contact Maplewood again. <br /> Carley pointed out that these are not holding ponds, but retention ponds. <br /> The drainage is still going into the 1al<e, but is slowed down by the <br /> retention pond. <br /> Page -15- <br /> <br />
