<br /> MINUTES <br /> City Council <br /> October 8, 1980 <br /> The foregoing resolution was duly seconded by Mr. Nadeau. <br /> ayes (5) Scalze, Nadeau, DeBace, Manson, Fahey. <br /> Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 247. <br /> There was no one present that wished to speak regarding the Condominium <br /> Conversion Ordinance. <br /> Councilman Fahey questioned the grounds for denial section of the Ordinance. <br /> Fahey wondered whether this section compared to what other cities have <br /> adopted. <br /> The Attorney stated that only about one or two other cities have adopted <br /> condominium conversion ordinances. Attorney Parks stated that the grounds <br /> for denial included in the City's ordinance are in compliance with State <br /> law. <br /> Councilman DeBace pointed out that the grounds for denial include a provision <br /> that condominium conversion can be denied if it is found that the availability <br /> of rental housing in the City is less than 4%. The Attorney stated that it <br /> would be at the discretion of the Council whether this provision was used. <br /> Mrs. Scalze introduced the following Ordinance and moved its adoption: <br /> ORDINANCE N0. 168 - AN ORDINANCE AMENDING THE LITTLE <br /> CANADA CODE BY ADDING A NEW CHAPTER 2701. CONDOMINIUM <br /> CONVERSION <br /> The foregoing ordinance was duly seconded by Mr. Nadeau. <br /> ayes (5) Scalze, Nadeau, Hanson, DeBace, Fahey. <br /> Nayes (0). <br /> Ordinance declared adopted. <br /> The City Clerk pointed out that this Ordinance does not apply in the case <br /> of the Grand Pre` or Fleur Royal condominium conversions. These conversions <br /> were in effect before this ordinance was introduced. The Attorney stated <br /> that Grand Pre' and Fleur Royal have filed declarations of conversion with <br /> the County Auditor. <br /> The City Clerk stated that the City is receiving park charges from Grand <br /> Pre' and Fleur Royal. <br /> Councilman DeBace questioned whether someone could get by without paying <br /> the park charge. The City Clerk commented that the City has to depend <br /> upon the Register of Deeds office to catch this park charge at c1osiny <br /> time. <br /> The Attorney stated that the pending park charges should show up in the title <br /> opinion on a property. <br /> The City Clerk suggested that the Council pass a resolution so that the <br /> portion of the Condominium Conversion Ordinance that pertains to park charges <br /> is recorded with the Recorder's Office. <br /> Page -4- <br /> <br />
