<br /> MINUTES <br /> City Council <br /> November 19, 1980 <br /> Councilman Fahey stated that he would like to begin rezoning the various <br /> areas of the City where it is needed to comply with the Comprehensive <br /> Plan. The Planner stated that this process could begin right away. <br /> Fahey stated that it does not make sense to have spent the money on the <br /> Comprehensive Plan and not rezone the City to comply with the plan. <br /> Councilwoman Scalze stated that the Comprehensive Plan is only a plan <br /> and not a document stating that the City must rezone. <br /> Fahey felt that now was the time to rezone the Schrier property on County <br /> Road C as a PUD. Fahey felt the City could reduce its exposure on this <br /> property before any monies are spent to develop the property. <br /> Fahey stated that 90% of the rezonings will not be controversial. They <br /> will just be label changes. <br /> The City Attorney stated that if rezoning the Schrier property would devalue <br /> the property, the City will end up in court. Attorney Parks stated that at <br /> the time Schrier made application fora building permit he had every right <br /> to do so, the only reason he was held up was due to the City's water system. <br /> Parks stated that the Schrier case may warrant special treatment. However, <br /> by the time the case got to court, the verdict may be the other way as <br /> courts are changing in these areas. <br /> Fahey suggested that a special meeting be set up for the fourth Wednesday <br /> in January to begin the rezoning of the non-controversial areas of the <br /> City. Fahey suggested that the Planner could give the Council a list <br /> of these areas. <br /> Hazardous Mayor Flanson stated that the City has received a letter stating that the <br /> Waste City will be considered fora hazardous waste dumping area. Councilwoman <br /> Scalze stated that this letter went to several cities. <br /> Mayor Hanson asked the City Clerk to give every Councilmember a copy of <br /> the letter. <br /> Condition Mayor Hanson stated that occasionally he gets complaints about the condition <br /> Of Yards of people's yards. The conditions of some yards could be either a health <br /> hazard or a fire hazard. Mayor Hanson asked the Council for their thoughts <br /> on what the City could do about this situation. <br /> Mrs. Nardini suggested that the City adopt an ordinance that allows the <br /> yards to be cleaned up if the owner will not do it, and the cost be put <br /> on the propertyowner's taxes. <br /> The Attorney stated that this would be hard to do because what is junk to <br /> one person might be an antique to another. Nine out of ten times the <br /> propertyowner would win in court. <br /> Page -11- <br /> <br />
