MINUTES <br />City Counc9l <br />January 14, 1987 <br />The Attorney stated that this was part of the compensation that was <br />due Mr. Frattalone. The Attorney further stated that the City could <br />pay both the contractor and Frattalone and take the loss. Parks <br />stated that the court costs that could be involved would cost more <br />than the claim. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-1-38 - AUTHORIZING TNE PAYMENT TO MR. MYERS <br />FRA7TALONE OF 132.00 AND fURTFIER AUThIORIZING THE REFUND OF <br />THE MONIES BEING WITHHELD FROM SHAFER CONSTRUCTION <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />qyes (5) Fahey, Nardini, Hanson, Scalze, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 21. <br />Clycie Mr. Clyde Hoffman has requested partial payment of $10,000 from the <br />Hoffman City for his work in constructing the warming house at the hockey rinks <br />Request near the Fire Barns. <br />FOR Partial <br />Payment Atto rney Parks reported that the City has received a garni shment against <br /> Mr. Floffman that was issued by Mr. Frank Fratta1one. The procedure that <br /> the City would follow would be to disclose within 20 days how much money <br /> the City owes Mr. Hoffman and the City would then have to withhold 110% <br /> from any payment to Mr. Hoffman. <br />Councilman Fahey stated that until Mr. Hoffman provides the City with <br />lien waivers on the building, the City does not owe him any money. <br />The Attorney stated that that was correct. Until the moment Mr. Hoffman <br />proviaes the City with lien waivers, the City owes him nothing. Therefore, <br />the City will disclose to the Flttorney for Mr. Frattalone tha~ Mr. Hoffman <br />does not have any money coming from the City. Mr. Parks stated that <br />the garnishment should be served at the time that the City becomes indebted <br />to Mr. Floffman. <br />Mr. Frattalone stated that public buildings cannot be liened. The <br />Attorney replied that there is a peculiar situation in this case due <br />to the location of the building in question. <br />Mr. Fahey introduced the following resotution and moved its adoption: <br />RESOLUTION N0. 81-1-39 - AUTHORIZING THE PAYMENT OF MR. <br />CLYDE HOFFMAN THE PFlRTIFlL PAYMENT OF $10,000 UPON <br />PRESENTATION BY MR. HOFFMFlN TO THE CITY OF LIEN WAIVERS FOR <br />THE WORK COMPLETED ON THE PROJECT FlS OF JANUARY 12, 1981 <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />qyes (5) Fahey, Flanson, Forsberg, Scalze, Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 22. <br />Page -13~ <br />
