MINUTES <br />City Council <br />February 11, 1981 <br />The people buying the Providences wanted a letter stating that the garage <br />would never need to be disturbed so that they would not have a problem <br />with the title. <br />Mr. Parks stated that he has sent this letter, and asked that the Council <br />ratify his actions. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTIQN N0, 81-2-72 - RATIFYING THE ACTIOM OF THE fITY <br />FlTTORNEY 41H0 THROUGH HIS LET7ER OF FEBRUFlRY 6, 1981 STFlTED <br />THAT THE ENCROACHMENT OF TNE GFlRAGE OWNED BY THE PROVIDENCES <br />APARTMEMTS ON THE CI7Y'S SANITARY SEWER EASEMENT DID NQT POSE <br />A PROBLEM <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />!{yes (5) Scalze, Nardini, Hanson, Fahey, forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Pages 43 and 4~. <br />Maryhouse The Attorney reported that he has checked into it and the easement on <br />which the City`s warming house is sitting is owned by Maryhouse, Flowever, <br />the easement has never been taxed, antl, therefore, Maryhouse has not had <br />to pay taxes on this property. <br />The Attorney stated that he would now try to work something out with <br />the Maryhouse people so that the City could purchase this property, <br />Park <br />Ordinance The Flttorney reported that he has not amended the City's park ordinance <br />to show the use of fair market va1ue rather than assessed value in <br />determining park charges. <br />Mr. Parks informed the Council that the State statute only gives the <br />City power where a property is a subdivision, Mr. Parks felt that the <br />Ordinance will need extensive revision~Parks stated that he wou1d have <br />these revisions ready by the February 25 meeting, <br />St. Jude's The Attorney stated that he will know in his next meeting with St, Jude's <br />Park Charge the situation with the park charges, <br />Councilman Fahey stated that St, Jude's was given a 6Q-day period in <br />which to negotiate its park charges with the City, These 60 days are <br />up. Mr. Fahey informed the Flttorney to write a letter to St, Jude's <br />and order them to cease construction until the park char9e situation is <br />settled. <br />Page -13- <br />
