MINUTC•S <br />CITY COUNCIL <br />March 4, 1981 <br />Rezoning Of Mayor Hanson opened the public hearing on the proposed rezoning of some <br />Property On property on County Road D from PUp and B-2 or Light Industrial to Single <br />County Road Family Residential, <br />D <br />The Planner stated that the City's previous PUD zoning did not have any <br />requirements. The piece that was zoned PUD is more or 1ess a pro6lem <br />piece of property. <br />Mayor Hanson stated that the present zoning of the small section of <br />property is unclear. From the minutes of the Council meeting that zoned <br />that property it is not possible to determine if the property was zoned <br />B-?_ or Light Industrial. <br />The Planner stated that the original zoning map shows the property as B-3. <br />Councilman Fahey asked if the City's notice on the proposed rezoning is <br />ciefective due to the unclear zoning on the property. The Attorney replied <br />that the notice is all right as long as the zoning the Council is proposing <br />for the property is correct. <br />The Mayor stated that the City must go by the zoning that is indicated in <br />the minutes rather than what is shown on the zoning map. The Attorney <br />stated that it is the resolution that controls what the zoning of a property <br />is. <br />Mayor Hanson stated that the original petition for the zoning of this <br />property was for B-3 and the Council zoned the property Light Industrial. <br />A resident of the area asked how the property being considered for rezoning <br />tonight would be developed. Mayor Hanson stated that the Council does not <br />know how this property would develop. The Council did recently have a plan <br />before them for the development of the property as multiple family dwellings. <br />This proposal was denied by the Council, The Council does not want this <br />property to develop in such a way as to landlock the property to the East <br />ancl~Jest, The Mayor also informed the residents of the area that the Council <br />has a thoroughfare plan for the area that the Engineer has proposed. <br />Mayor Hanson stated that the Council wants to consider the total area <br />for development, <br />P4rs. Scalze informed the residents that if someone peti.tions for a road <br />in this area, all the residents within 350 feet wi11 6e notified and a <br />public hearing will be held. <br />Councilman fahey stated that only properties benefited by a new road would <br />be assessed for it. Also the City would not put in a road unless the <br />property owners wanted to develop their property, The zoning of a property <br />would not effect whether or not a road went through, <br />Mrs. Scalze informed the area res5dents that the zoning of the property <br />would limit the type of development that could go in, <br />Mr. Forsberg stated that the City is proposing keeping this area single <br />family residential. <br />Page -5- <br />
