MINUTES <br />City Council <br />Flpril B, 1981 <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />~yes (5) Forsberg, Fianson, Fahey, Nardini, Scalze, <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 113. <br />Kath Mr. Kath appeared before the Council requesting a variance for an <br />Expansion addition to his building he is proposing. <br />The Planner stated that the addition could not be built without a <br />variance. The variance would be needed on the setback to Woodlyn <br />Flvenue. The building would come six feet from the right-of-way. <br />The Planner stated that most cities' ordinances provide for an exemption <br />to setbacks in order for buildings to conform to the setback of the <br />surrounding buildings. The City of Little Canada's ordinance does not <br />provide for this. The Planner stated that he feels an amendment should <br />be added to the City's ordinance to provide this. <br />Without the amendment, the building would need a variance and this <br />requires that a public hearing be held. <br />The City Attorney stated that in some cases it is desirable to have <br />the setback on a building the same as the surrounding building. <br />The Attorney suggested that the Councit immediately amend the ordinance <br />and then a public hearing would not have to be held on the Kath request. <br />Mrs. Scalze stated that she is not in favor of amending the ordinance <br />to fit this situation. The Attorney stated that this would not be the <br />case as this amendment should have been in the ordinance. <br />Mr. Fahey stated that he was not in favor of the variance. Fahey asked <br />if the size of the building could be reduced to meet setback requirements. <br />Fahey also stated that there is such a thing as getting too big for the <br />property. <br />The Attorney stated that ~f the Council grants a variance without a <br />hardship existing, the Council will have set a precedent. <br />Fahey stated that he sees no hardship in this case. <br />Mrs. Scalze stated that she would like to take a 1ook at the situation. <br />Fahey stated that a lot of other people have been deniad variances that <br />have had better reasons. <br />The City Clerk reported that the earliest a public hearing could be <br />held would be at the May 13 Council meeting. <br />Mr. Hanson introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-4-174 - CALLING FOR A PUBLIC HEARING <br />ON THE VARIANCE REQUEST FOR KATH BROS.
