r~iNUr~s <br />City Council <br />April 22, 1981 <br />Dike In <br />Maplewood <br />A7ong <br />Little <br />Canada <br />Boundary <br />Mr, Jim Pogreba appeared before the Counci7 regarding the dike that a <br />developer has built in Maplewood along the Little Canada border, <br />Mr. Pogreba stated that he has contacted Maplewood, the Watershed <br />District, the County, and the Army Corps of Engineers regarding this <br />dike. It appears that no one will make the developer move the dikes <br />as it would be too expensive. <br />Mrs. Scalze reported that the ditch is on the property line and it is <br />blocking the drainage of the Pogreba and Scully property. <br />Mr. Pogreba asked if Little Canada has any r9ghts in what is developed <br />along its boundaries. <br />The Flttorney stated that if it is a natural water course, it cannot <br />be blocked. However, if it is just natural surface run-off, they <br />can block this. <br />The City Engineer stated that one of the engineers in his office was <br />told that the City of Maplewood would look at this situation. <br />Mr. Forsberg stated that the City should have a written report on this <br />and refer it back to the City of Maplewood. <br />Mr. Parks stated that this is a private matter and if the dike is blocking <br />a natural waterway, Mr. Pogreba has the right to forbid this. If it is <br />ordinary surface run-off,the developer has the right to build the dike. <br />Mr. Pogreba stated that the area is designated as a wet1ands. <br />Mr. Fahey stated that it may be helpful to the City to be involved in <br />this. <br />Mr. Forsberg introduced the following resolution and moved its adoption: <br />RESOLUTION P10. 81-4-201 - INSTRUCTING THE CITY ENGINEER <br />TO DETERMINE IF THERE IS A NFlTURAL WATER~IAY THAT IS BEING <br />BLOCKED BY THE DIKE BUILT IN MFlPLEWOOD ALONG TFIE LITTLE <br />CANADA BOUNDARY AND REPORT 6ACK TO THE COUNCIL ON THIS <br />SITUATION SO THAT THE COUNCIL CAN MAKE RECOMMENDFlTIONS TO <br />THE CITY OF MAPLEWOOD ON WHAT SHOULD BE DONE TO CORRECT THE <br />DRAINAGE PROBLEMS CAUSED BY THIS DIKE <br />The foregoing resolution was duly seconded by Mrs. ~lardini. <br />qyes (5) Forsberg, Nardini, Hanson, Fahey, Scalze. <br />Nayes (0), <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 134. <br />Maryhouse Attorney Parks stated that Jim Morelan has asked that he be a7lowed to <br />meet with the Maryhouse people concerning the warming house which is <br />lqcated on their property. Parks stated that they are hoping the City <br />w~ll be ab1e to buy the property or lease it from Maryhouse. <br />Page -17- <br />
