MINUTES <br />City Council <br />April 22, 1981 <br />Attorney Parks informed the Council that when the ditch was staked <br />out, the stakes were moved in order to save a line of trees on the <br />Stenger property. Parks stated that representatives from the City <br />were present and agreed to the stakes being moved to save the trees. <br />Fiowever, apparently someone moveci the stakes again, and this is how <br />the ditch on the Costa property came to be in the wrong location <br />from the easement that Mrs. Costa agreed to. <br />Parks stated that the ditch is within the easement right-of-way, but <br />not where it is supposed to be. ~ttorney Parks felt Mrs. Costa had <br />a valid argument. <br />Councilman Fahey felt that the Attorney should try to negotiate with <br />Mrs. Costa in order for the City to obtain a corrected easement. <br />Mr. Forsberg introduced the following resolution and moved its adoption: <br />RESOLUTI0~1 ~10. 81-4-204 - INSTRUCTING ThIE CSTY ATTORNEY <br />T MEET WITH JENNY COSTA REGARDIMG THE DITCH EASEMENT <br />ON HER PROPERTY FlND REPORT BACK TO TFIE COUNCIL WITH SOME <br />TYPE OF PROPOSAL FOR THE SOLUTION ~F TFIE PROBLEM <br />Watermain <br />& Sewer <br />Line <br />Report <br />Hoggsbreath <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (5) Forsberg, Fahey, Hanson, Sca1ze, Nardini. <br />Nayes (O). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 136. <br />The City Engineer submitted to the Council a report outlining the areas <br />of Little Canada that do not have watermain and sewer lines, <br />Mayor Hanson suggested that Councilmembers look over the report and <br />try to get the feelings of the people in these areas regarding if <br />they would like these improvements. <br />Mayor Flanson informed the Council that the City has received a letter <br />from Mr. Jim Strouth regarding an incident that took place outside of <br />Noggsbreath. <br />hianson reported that he and Mr. Forsberg went to Hoggsbreath, and they <br />do have someone patroling their parking lot. Elanson a1so stated that <br />Mr. Grady is constructing a new fence on his property. <br />Hanson stated that th e parking situation at Hoggsbreath leaves something <br />to be desired and that there are no fire lines in the parking lot. <br />Hanson stated that the Council will received some information from the <br />Fire Marshall regarding if the seating capacity is being exceeded at <br />Hoggsbreath. <br />Page -21- <br />
