MINUTES <br />City Counci1 <br />April 29, 1987 <br />Mrs. Scalze pointed out to Mr. Schrier that the City does have a <br />requirement for a park land dedication fee, whether it is taken in <br />land or 10% of the cash value of the property. <br />The City Clerk pointed out that the townhouses if so1d as condos would <br />have zero lot lines. Mayor Nanson felt this could be handled the same <br />as ~artment conversions to condos. <br />Mrs. Nardini asked what the shorel~ne setback would be on the quads. <br />Mr. Leen indicated that the drawing before the Council was only a <br />concept drawing. Leen stated that they would comply with DNR <br />regulations as there is City sewer in the area. <br />Mr. Dennis Doody asked where the drainage of the area would end up. <br />The City Clerk stated that there are storm sewers on County Road C. <br />Mayor Hanson indicated that the drainage from the Market Place and Iona <br />Lane goes into Round Lake. <br />Mr. Fahey 9ndicated that the Council must act on this property within the <br />next 30 days. If not, the City's moratorium on apartment buildings <br />will go off and the property will remain zoned R-1 and R-3. Under <br />the City's code the Council would be in an almost undeniable situation <br />to turn down apartments if Mr. Schrier came in for a building permit. <br />Fahey asked Mr. Schrier if he were willing to commit to a PUD. Otherwise, <br />Fahey felt the property should be downzoned to R-2 and some time in the <br />future the Council could give consideration to an R-2 PUD. <br />Mr. Forsberg indicated that under R-2 zoning, the senior citizen development <br />would not be a7lowed. <br />fahey stated that the Council cannot go by the drawing Mr. Schrier has <br />submitted. The Council must have something in writing from Schrier. <br />Mayor Hanson stated that he does not feel Mr. Schrier is opposed to <br />working with the Council on a PUD. <br />Schrier informed the Council that he would not have spent the time and <br />money on this proposal if this were the case. Schrier's concern was <br />that it is a long process to put together a senior citizen program. <br />Mr. fahey asked if the majority of the Council felt P4r. Schrier's <br />proposal was acceptable as presented and included the triangular <br />piece of property, would Mr. Schrier enter into an agreement that the <br />property would be developed as proposed. Fahey a1so indicated that if <br />the Council does nothing on this property, Mr. Schrier will have the <br />City over a barrel. <br />Mr. Schrier rep7ied that he does not know if funding is available for <br />a senior citizen development, but that he is u~illing to explore the <br />funding and make application for it to see if the program is avai1able. <br />fahey felt that the property could be reserved for elderly housing <br />contingent upon the funding being available, and if not available, <br />Page -4- <br />
