MINUTES <br />City Council <br />Flpr91 29, 1981 <br />this portion of the property could be open for reconsideration for <br />whatever zoning is appropriate. Fahey does not want the property <br />sitting as R-3 as Schrier could sell the property and someone else <br />could come in asking for a building permit for apartments. Fahey <br />~Felt the City should have some sort of agreement in writing with <br />Mr. Schrier. <br />Mr. Schrier stated that he has a lot of money invested in this property. <br />There are many legal questions involved. Schrier also pointed out that <br />he did not zone the property, the property was zoned R-3 for many, many <br />years. The value of property is based on its density. Schrier stated <br />that he is willing to explore the possibility of senior citizen housing, <br />but he would not be able to give the Council a concrete answer within <br />30 days. <br />Mr. Forsberg asl<ed if Schrier would be allowed to go with the rest <br />of the development, other than senior citizens portion, or hold up <br />the development of the whole piece of property. <br />Mr. Doody asked if the senior citizen proposal did not go through, what <br />would be the alternative for this piece of property. <br />Mrs. Nardini stated that the City cannot downzone the Schrier property <br />without paying damages. Nardini felt the issue should be put before the <br />citizens. <br />Mr. Forsberg stated that he has had a lot of people tell h9m tha~ the <br />Gity shou7d not pay the cost for downzoning this property. The audience <br />expressed concern that these people do not attend the meetings where <br />this subject is being discussed. <br />Mr. Pierce stated that Schrier should not be allowed to develop the <br />property with the exception of the piece set aside for sen~or citizen <br />housing because what will happen is that he will have 2/3 of the <br />property developed and will still have a piece of R-3 property. <br />Mayor Hanson stated that he feels Mr. Schrier cannot develop the <br />townhouses until he gets a rezoning on the R-1 property. <br />Forsberg asked if the Council will O.K. a portion of the property, or <br />hold the whole proposal up. <br />Fahey stated that he would still like an answer to the question of <br />whether or not P4r. Schrier is willing to enter into an agreement with <br />the City to pursue the senior citizen housing. The agreement wou1d <br />reserve the property for the senior citizens development and no apartments <br />could be built on the property while Mr. Schrier is exploring the <br />senior housing. <br />Mr. Leen stated that should Mr. Schrier be turned down for senior <br />citizen housing funding, he should have the prerogative to build <br />conventional apartments. <br />Page -5- <br />
