MINUTES <br />City Counci1 <br />May 13, 1981 <br />Mrs. Sca7ze asked if senior citizen housing would be a1lowed on a p9ece <br />of property zoned R-2 PUQ. The City Planner replied that he did not <br />believe it would be allowed under this zoning. The Planner suggested <br />that the property be zoned PUD, and the Schrier proposal would be the <br />basis for the PUD zoning. <br />Mr. Fahey 9ntroduced the following resolution and moved its aciopt9on: <br />RESOLUTION N0. 81-5-230 - REMOVING THE PROPOSED RE70NING <br />TFIE SCHRIER PROPERT fROM TABLE <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />Flyes (5) Fahey, Nardini, Hanson, Forsberg, Scalze. <br />Nayes (0). <br />Resolution declared adopted. <br />This reso7ution appears in Resolution Book Plo. 7, Page 173. <br />Mr. Fahey put a motion on the floor to downzone the Schrier property <br />firom R-3 to R-2, which inc1udes the property bordering on Round Lake <br />and the triangular piece of property, with the ind9cat9on to Mr. <br />Schrier that the Council is interested in discussing a PUD zoning <br />for the property, as it 5s important for the City to retain control <br />of the entire City and risk liiigation and potential damages to the <br />City for which the City has purchased insurance to cover this type <br />of situation. P~r. Fahey's motion d9e~ for 1ack of a second. <br />The Mayor suggested that P~r. Schrier make application to the City <br />for a PUD zoning on the proposal that he had submitted. <br />The C~ty Clerk also pointed out to the Council that Mr. Schr~er is under <br />no obligation to request a PUD rezoning. <br />Mayor Hanson stated that he is gambling that Mr. Schrier wi11 make such <br />a request. <br />Councilman Fahey infiormed the Council that it was his view that the other <br />four Counc9lpersons are in favor of apartments. <br />Councilwoman Nardini stated that what Mr. Fahey should see is four <br />Councilpeople who are not in favor of spending City money to pay damages. <br />Mr. Fahey replied that this was the purpose of buying the insurance <br />to cover such a situation. The City Attorney replie~ that he does not <br />bel9eve Mr. McMamara, the City's insurance agent, understood this to be <br />the purpose the City purchased the 9nsurance for. <br />Mr. Fahey suggested to the other Councilmembers that they should not <br />make statements saying they are not in favor of apartment buildings <br />in the City if they are not willing ~o downzone the Schrier property. <br />M~~. ForsEerg informed Mr. Fahey that he was still not in favor of <br />additional apartment bui1dings in the City. <br />Page -18- <br />
