MINUTES <br />City Council <br />May 13, 1981 <br />Pedestrian The Engineer~ reported that the he has determined tha~ the City must make an <br />Wa1k-Way offScial request to the District Engineer of the State N9ghway Department <br />Over for a pedestrian walkway over the freeway. <br />Freeway <br /> Mrs. Nardin9 informed the Council tha.t it was he r understanding that <br /> when the freeway was put in cutti ng the City in half, the Highway <br /> Department made some concessions to the City in terms of a pedestrian <br /> walkway. <br />The Engineer stated that he thought this was true. The walkway was to <br />be put in to allow children to wa1k across the freeway to get to school. <br />The Highway DeparCment wanted a letter from the School Board making this <br />request, and the School 6oard did not request this because of some law <br />regarding busing. <br />Mrs. Scalze introduced the fol1owing resolution and moved its adoption: <br />RESOLUTION N0. 81-5-233 - DIRECTING THE CITY CLERK TO <br />RESE RCH THF FILES TO DETERMINE WHAT CONCESSIO~S WERE <br />MADE TO TFIE CITY OF LITTLE CANADA REGFlRDIN~ Fl PEDESTRIAM <br />WALK-WAY FlND FURTHER TNSTRUCTING TFIE CITY CLERK TO MAKE <br />A FORMFlL REQUEST OF THE DISTRICT ENGIMEER OF THE STATE <br />FIIGHWFlY DEPARTMENT FOR Fl PEDFSTRIAN WALKWAY OVEP. THE <br />f RE EWAY <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />qyes (5) Scalze, Flanson, Forsberg, Nardini, Fahey. <br />Nayes (O). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book ~lo. 7, Pages 175 and 176. <br />Jenny The City Flttorney reported that he spoke to Jenny Costa regarding the <br />Costa solution to the drainage ditch easement matter. P~rs. Costa would like <br />P~atter the culvert ~inder Centerville Road made bigger as she feels it cannot <br />handle the water. Mrs. Costa would also 1ike her ditch cleaned out. <br />Mrs. Costa wou1d a1so like some additiona1 money in payment for the <br />easement, but does not want to discuss this until the ditch is cleaned <br />and the culvert is enlarged. <br />Mr. Fahey stated that he has reconsider•ed the matter and feels the clitch <br />is within the easement. <br />The Flttorney stated that the ditch is closer to Mrs. Costa's house and <br />has reduced the size of her backyard. <br />Fahey felt that as long as the City has the easemerrt and the ditch is <br />within the easement it does not matter where within the easemen't it is. <br />The Attorney stated that Mrs. Costa would like her son present when she <br />discusses a solution to this problem. The Flttorney suggested that a <br />meeting be set up with Mrs. Costa, Pete Costa and Mrs. Costa's Flttorney <br />to discuss the matter. <br />Page -21- <br />
