MINUTES <br />City Council <br />June 24, 1981 <br />Mini Mrs. Nardini reported that traffic signs and the slatting of a fence <br />Shopping at the mini shopping center on Litt1e Canada Road and Lakeshore were <br />Center a requirement of the Council. Nardini further reported that the City <br />had a bond to ensure that this was completed, however, the bond has <br />now expired. <br />Mayor Hanson suggested that the City ask for the Planner's recommendations <br />on this. <br />Council discussed the situation wherein bonds have a termination date <br />and after they have expired, the City has nothing to fall back on should <br />all requirements of a development not be complied with, <br />Mayor Hanson suggested that the City require cash rather than a bond in <br />these situations. Mr. Forsberg asked if the City required cash, if it <br />would be liable to pay interest on the money. <br />Mayor Hanson suggested that the Council get the Planner's recommendations <br />on requiring cash rather than a bond. <br />Phalen <br />Lake Mr. Fahey reported that the City Manager of Maplewood has submitted a <br />Overf1ow report outlining the various percentages that cities contribute to the <br />Matter Phalen Lake overflow situation. These percentages are as follows: <br />Falcon Heights 1.1% <br />Little Canada 17.3% <br />Maplewood 35.7% <br />North St. Paul 10.6% <br />Oakdale 3.8% <br />Roseville 8.0% <br />Vadnais Heighi;s 7.6% <br />White Bear Lake 15.9%. <br />It has been suggested that the legal cost for any future law suit against <br />the City of St. Paul and Metro Sewer be divided among the above listed <br />cities according to these percentages. <br />Mrs. Nardini questioned whether these percentages were accurate. The <br />City Engineer stated that he felt the percentages were correct. <br />The City Clerk reported that Maplewood got these percentages from the <br />Metro Sewer Board and he, also, felt they were accurate. The City <br />Clerk also stated that all other cities are agreeing with this report. <br />Mr, fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-6-325 - APPROVING THE CITY'S PARTICIPATION <br />IN ANY POTENTIAL LITIGATION FlGAINST THE CITY OF ST, PFlUL AND <br />METRO SEWER REGARDIMG TFIE PHALEN LAKE OVERFLQW AT TFIE RATE OF <br />17.3% AS RECOMMENDED BY THF. C,ITY ENGINEER AND THE REPORT OF <br />THE CITY MFlNAGER OF TNE CITY Of MAPLEWOOD <br />Page -23- <br />
