MINUTES <br />CITY COUNCIL <br />JULY 8, 1981 <br />Mr. Fahey introduced the following resolution and moved its <br />adoption: <br />RESOLUTION NO. 81-7-334 - APPROVING THE BUILDING PERMIT <br />FOR THE FLAMEBURGER RESTAURANT CONTINGENT UPON: <br />1. THEIR PROPER LOCATION OF SITE ON R2CE STREET IN <br />ACCORDANCE WITH THE PLANNER'S REPORT OF JULY 2~ 1981. <br />2. UPON THEIR SUBMISSION AND SATISFACTORY REVIEW AND <br />APPROVAL BY THE CITY COUNCIL OF THEIR LANDSCAPING AND <br />SCREENING PLAN WHICH SHOULD BE PRESENTED ON JULY 22. <br />3. THAT THE SITE READING AND DRAINAGE FOR THE AREA <br />INCLUDING THEIR LOT BE APPROVED BY THE CITY ENGINPER <br />AND HIS REVIEW BE PRESENTED TO THE CITY COUNCIL FOR <br />THEIR APPROVAL BY THE JULY 22ND MEETING WITH THE <br />UNDERSTANDING THAT THESE RECOMMENDATIONS WILL BE GIVEN <br />TO THE DEVELOPER PRIOR TO JUBY~:2~O~TH FOR HIS CONSIDERA- <br />TION. <br />4. THAT THERE BE NO EXCAVATION~ GRADING OR CONSTRUCTION <br />PURSUANT TO 2HE BUILDZNG PERMIT UNTIL FURTHER ACTION BY <br />THE COUNCIL ON THE JULY 22ND MEETING.. <br />INCLUDE AS PART OF THE BUILDING PERMIT TWO VARIANCES FOR <br />REASONS OF IMPROVING THE LAND USE CIRCULATION AND THE <br />FIGURATION OF THE LOT, ALLOW TWO DRIVEWAYS WITH THE <br />134.5 FEET STREET FRONTAGE ON DEMONT AVE. RATHER THAN TFIE <br />REQUIRED 250 FEET~ AND ALSO THE CURB ON THE WEST SIDE OF <br />THE DEMONT AVE. DRIVEWAY, AS STATED IN THE PLANNER'S <br />REPORT~ BG ALLOWED TO ABUT THE PROPERTY LINE RATHER <br />THAN~MEETING THE REQUIRED FIVE FEET ON THE PERIMETER. <br />THIS EXTRA DRIVEWAY WILL GENERALLY IMPROVE THE TRAFFIC <br />WITHIN THE SITE. THE GRAN,TING OP THZS VARIANCE WOULD NOT <br />IMPAIR ADE9UATE LIGHT TO PROPERTY OR ANY OTHER FACTORS <br />MENTIONED IN OUR ORDINANCE REGARDING VARIANCES. INCLUDE <br />THE RECOMMENDATION OF THE PLANNER THAT THE BUILDING PER- <br />MIT BE CONTINGENT UPON THE SUCCESSFUL NEGOTIATION OF A <br />BOND LEASE AGREEMENT WITH THE ABUTTING LAND OWNER CON- <br />CERNING USE OF THE DRIVEWAY. <br />2he foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (5) Hanson, Fahey, Forsberg, Nardini and Scalze. <br />Nayes (0 ) <br />This resolution appears in Resolution Book No. 7, Page 245. <br />Page 3 <br />
