MTNUTES <br />City Council <br />October 28, 1981 <br />Watermain Mayor Flanson opened the public hearings on the improvement of Edgerton <br />Improvement Street from LaBore Road to County Road D by watermain, the improvement <br />No. 82-1 of Edgerton Street from LaQore Road to L7ttle Canada Road by watermain and <br />Public improvement of County Road D from Edgerton to Payne Flvenue by watermain. <br />Hearings <br />The City Clerk stated that the f9rst hearing was initiated by a petition <br />and the other two sections of the improvement were added on at the <br />suggestion of the Engineer for looping purposes. <br />The City Clerk also informed the Council that the C9ty received a petition <br />against the improvement. There are 85 parcels in the improvement and <br />the petition consists of 51 parcels that are against it. Of the 51 <br />against, 41 are within the petition area. <br />The City Clerk stated that some of the names are on both the petition <br />requesting the improvement hearing and the pet9tion against the <br />improvement. The City Clerk stated that the first petition acknow7edges <br />that there are 35% of the property owners requesting that a hearing be <br />called on the improvement. <br />Mrs. Scalze stated that there are 41 property owners in the petition area <br />against the improvement. Scalze asked how many parcels tota1 in the <br />petition area only. The Clerk replied that there are about 53 parcels <br />in the petition area. The Clerk stated that it is quite evident that the <br />majority of the people are against the improvement. <br />One property owner in the area asked if some time in the future the City <br />might force water on Edgerton. Mr. Fahey stated that a 4/5's vote of the <br />Council would be needed to put water in at Council initiation. Fahey <br />stated that it could be possible that a Council would put the improvement <br />in for purposes of fire protection, for example. Fahey stated that he <br />was not in favor of forcing water on anyone, but he could not speak <br />for what might happen in the future. <br />Mrs. Nardini stated that it could happen that Metro Council wou7d force <br />water. <br />Carl Spooner stated that Council recently ordered that interest be paid <br />on deferred assessments. Mr. Spooner asked the rate of interest that <br />would be charged. Spooner also commented that there would be no advantage <br />to having a deferred assessment if a person had to pay interest on it. <br />Mr. Fahey pointed out that State Law requires that senior citizens be <br />charged interest on their deferred assessments. Fahey stated that the <br />Council wanted to treat everyone the same and if senior citizens are <br />required to pay interest on these assessments, other people with deferrments <br />should also be required to pay interest. <br />Mr. Hanson stated that the rate of interest that is charged is the rate <br />that was in effect at the time the bond was issued. The Engineer commented <br />that the rates run from 6% to 12%. <br />Mr. fahey commented that the interest only runs for the length of the <br />improvement. <br />Page -3- <br />
