MINUTES <br />City Counci1 <br />October 28, 1981 <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-10-632 - APPROVING THE CONDITIONAL USE <br />PERMIT fOR A DUPLEX AS REQUESTED BY MR. PERRY SFIORTAGE WITH <br />THE FOLLOWING CONDITIONS: THAT IT IS UNDERSTOOD THAT MR. <br />SFIORTFlGE WILL NOT BE GRANTED A LOT SPLIT IN THE FUTURE TO IN <br />EFFECT ALLOW TG10 SIN~LE FFlMILY HOMES EACH ON A 37 1/2 FOOT LOT, <br />AND THAT THE SITE PLAN BE REVISED TO REFLEC7 ONE DRIVEWFlY THAT <br />CONFORMS WI7H CITY ORDTNANCE REQUIREMENTS AND THAT THE PLACEMENT <br />Of ThIE DRIVEWAY AND SITE PLAN BE APPROVED BY THE PLANNER FlS WELL <br />FlS ALL OTHER ASPECTS OF THE PLFlN PRIOR TO ANY COMMENCEMENT OF <br />CONSTRUCTION AND THAT THESE CONDITIONS BE PLACED ON THE <br />CONDITIONAL USE PERMIT <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />Ayes (5) Fahey, Hanson, Forsberg, Nardini, Scalze. <br />Nayes (0). <br />Reso1ution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 410. <br />The Attorney stated that the property was R-1 and until the City's ordinance <br />was amended the house could not be sp19t. <br />The Planner stated that there is some provision in the City's ordinances <br />for zero lot 7ines under a PUD. <br />The Planner also stated that there are various property owners involved <br />in condominiums. The Attorney stated that a condominium is not the same <br />thing as a zero lot line situation. In a condominium a sale of a unit <br />must be approved by the association, but in a zero lot line situation <br />one of the homes can be sold without the approval of the other owner. <br />Mrs. Nardini informed Mr. Shortage that the City wil'I need a corrected <br />copy of the plan. <br />Mrs. Nardini commente~ that she would like a hearing to be called on the <br />duplex in an R-1 area situation. <br />Mayor Hanson asked that the Council discuss this further along in the <br />agenda. <br />Conditional Mr, Wm. Gear appeared before the Council requesting approval of a conditional <br />Use Permit use permit for construction of an additronal garage on his property. <br />Fldditional <br />Garage Mr. Fahey commented th~t he disagreed with the way the Council recently <br />Wm. Gear handled the situation of conditional use permits for additional garages. <br />Fahey stated that if these have not been required for other people in <br />the City, the permit should not be required for Mr. Gear. <br />Mrs. Nardini commented that the City has established a procedure for <br />requiring these permits, and the Council should stick with it. Mrs. <br />Scalze stated that she agreed. Scalze commented that the Council is <br />paying an attorney and the Council should do what he advises. <br />Page -H- <br />
